THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, removal of an erroneous academic evaluation report (AER) from the interactive Personnel Electronic Records Management System (iPERMS).

2.  The applicant states when he attended the Field Artillery Officer Basic School he was given an AER that shows he achieved course standards.  He provided that AER to the Oklahoma Army National Guard (OKARNG).  He discovered the situation when he applied for active duty but was told that it would not adversely affect his career.  He states it is unjust that promotion boards will see this duplicate document.

3.  The applicant provides copies of two AER's for his basic course, ending on
13 June 2001:

* one shows he achieved course standards –it has one paragraph describing his performance during the course
* the second AER is identical, but it contains a second paragraph justifying a marginal rating

CONSIDERATION OF EVIDENCE:

1.  The applicant attended the subject school in 2001 as a second lieutenant in the OKARNG.  He accepted appointment in the U.S. Army Reserve on 
8 September 2008 and is currently on active duty in an Active Guard Reserve status.
2.  The applicant's file in iPERMS contains only the version of the AER that justifies marginal achievement of course standards.

DISCUSSION AND CONCLUSIONS:

1.  The applicant provided no substantiating evidence to show the AER indicating marginal achievement is an error or injustice.  Only one version of the subject AER is in his iPERMS record; this is the version of the AER that justifies marginal achievement of course standards.  His record also does not show he was presented an AER showing he achieved course standards.

2.  In view of the foregoing, the applicant's request should be denied.
