THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).
	
2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that she be granted a Dental Additional 
Special Pay (DASP) contract retroactive to 2013.

2.  The applicant states the contract was inadvertently forgotten because there was a change in personnel and it slipped through the cracks.  She did not notice that she had not been paid because she had received a payment from her Dental Officer Multi-Year Retention Bonus (DOMRB) and thought it was the DASP also.

3.  The applicant provides no additional documents with her application.

CONSIDERATION OF EVIDENCE:

1.  The applicant was serving as a U.S. Army Reserve (USAR) Dental Corps lieutenant colonel when she was ordered to active duty on 2 January 2006.  She was promoted to the rank of colonel on 1 October 2010.

2.  Her official records show DASP contracts in effect from 2008 to 2012.

3.  A staff advisory opinion was obtained from the Office of the Surgeon General (OTSG) which opines, in effect, that while the contract effective date is the date the officer executes the contract, the applicant was eligible for DASP at $15,000 per year during the period in 20130428 – 20140427 and it would have been approved; however, there was no evidence of the applicant submitting a contract in 2013.  The advisory opinion was provided to the applicant for comment and she responded to the effect that she desires the issue to be resolved because she cannot apply for a 2014 contract until the issue is resolved.

DISCUSSION AND CONCLUSIONS:

1.  While it is the officer’s responsibility to submit a contract within a timely manner, the approving authority has opined that her contract would have been approved had it been received.

2.  Given that the applicant was fully eligible, it would be in the interest of equity to grant her a retroactive DASP contract at $15,000 per year for the period 20130428 – 20140427 and to pay her accordingly.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing she timely applied for and was granted a DASP contract for the period 20130428 – 20140427 and paying her accordingly.
