THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect correction of his records to show award of the Multinational Force and Observers Medal.
2. The applicant states:
* he was deployed as a part of the United Nations peace-keeping multinational force and observers (MFO) in the Sinai Peninsula
* he was deployed in 1983 while assigned to Company A, 2nd Battalion, 508th Infantry Division
* the campaign is not shown on his DD Form 214 (Certificate of Release or Discharge from Active Duty) and was overlooked by the separations branch
* he was treated twice while he was deployed and his medical records can verify his service in the Sinai Peninsula
3. The applicant does not provide any additional evidence.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant enlisted in the Regular Army on 13 July 1982. He completed training and was awarded military occupational specialty (MOS) 11B (Infantryman).
3. His DA Form 2-1 (Personnel Qualification Record Part II) shows in:
* item 5 (Oversea Service) Africa, Middle East Area (AMEA) Sinai from 17 February 1982 through 18 August 1982, temporary duty
* item 9 (Awards, Decorations, and Campaigns), in part, does not show award of the Army Service Ribbon
4. On 29 June 1984, he was released from active duty. His DD Form 214 shows in:
* item 12f (Foreign Service) 6 months and 9 days
* item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized)
* Armed Forces Expeditionary Medal
* Expert Marksmanship Qualification Badge with Rifle Bar (M-16)
* Sharpshooter Marksmanship Qualification Badge with Grenade Bar
* Combat Infantryman Badge
* Parachutist Badge
5. Army Regulation 600-8-22 (Military Awards) states:
a. The Multinational Force and Observers Medal was accepted by the President for the U.S. Armed Forces on 28 July 1982. To qualify for the award, personnel must have served with the Multinational Force and Observers at least 90 days cumulative after 3 August 1981. Periods of service on behalf of the Multinational Force and Observers outside of the Sinai and periods of leave while a member is serving with the Multinational Force and Observers may be counted toward eligibility for the Multinational Force and Observers Medal.
b. The Army Service Ribbon was established by the Secretary of the Army on 10 April 1981. Effective 1 August 1981, all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status are eligible for the award upon successful completion of initial entry training.
6. Army Regulation 635-5 (Separation Documents), in effect at the time, served as the authority for the preparation of the DD Form 214. The regulation in effect at the time made no provisions for entering service with the MFO peace-keeping force on the DD Form 214 as it currently does for service in imminent danger areas.
DISCUSSION AND CONCLUSIONS:
The evidence of record shows the applicant served a qualifying period of service for award of the Multinational Force and Observers Medal and Army Service Ribbon; therefore, he is entitled to correction of his DD Form 214 to show these awards.
