BOARD DATE: 2 September 2014
DOCKET NUMBER: AR20140000700
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his date of birth (DOB) as 28 February 1973.
2. The applicant states:
* his DOB should be shown as 28 February 1973
* he should be listed as retired from the Army
3. The applicant provides no additional evidence.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant enlisted in the U.S. Army Reserve (USAR) under the Delayed Entry Program (DEP) on 22 October 1992. He was discharged from the USAR DEP and enlisted in the Regular Army on 18 November 1992 for a period of 3 years.
3. His DD Form 4 (Enlistment/Reenlistment Document Armed Forces of the United States) shows his DOB as 28 February 1973.
4. On 24 April 1999, he was retired by reason of temporary disability and placed on the Temporary Disability Retired List the following day.
5. His DD Form 214 shows in:
* item 5 (DOB) 20 February 1973
* item 23 (Type of Separation) RETIREMENT
DISCUSSION AND CONCLUSIONS:
1. The applicant contends he was born on 28 February 1973 and his DD Form 4 supports this contention. Based on the foregoing evidence, it would be appropriate to correct item 5 of his DD Form 214 to show his DOB as 28 February 1973.
2. The evidence of record supports the applicant's contention that he should be listed as retired from the Army. Item 23 of his DD Form 214 properly shows the type of separation as "RETIREMENT" which indicates his retired status Therefore, no corrective action on this issue is required.
BOARD VOTE:
________ ________ ________ GRANT FULL RELIEF
___X_____ ___X_____ _X___ GRANT PARTIAL RELIEF
________ ________ ________ GRANT FORMAL HEARING
________ ________ ________ DENY APPLICATION
BOARD DETERMINATION/RECOMMENDATION:
The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting from item 5 of his DD Form 214 the current entry and replacing it with the DOB shown on his DD Form 4.

The applicant states the penciled in correction of his DOB on his DD Form 214 was done by the officer on duty at the time of his discharge. It states the purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge. Therefore, the USAR ID card is accepted as sufficient evidence to support correction of his DD Form 214 to show his DOB as 28 December 1932.

The applicant requests correction of his official military personnel file by changing his date of birth from 15 December 1947 to 15 December 1946. The applicant requests, in effect, correction of Item 12c (Net Active Service This Period) or Item 12d (Total Prior Active Service) of her DD Form 214 (Certificate of Release of Discharge from Active Duty) for the period ending 1 May 1993. The evidence of record shows the applicant enlisted in the USAR on 17 September 1992 and she entered on ADT on 4 January 1993. This DD Form 214 properly shows no prior active service in Item 12d since records show she did not accrue any additional active...

The applicant requests, in effect, that item 12d (Total Prior Active Service) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period from 8 November 1979 to 28 August 1992, which will simply be referred to as his DD Form 214 throughout the remainder of these proceedings, be changed to show that he had 4 years of total prior active service. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants...

Chapter 2 contains guidance on the preparation of the DD Form 214 and states that items 4a and 4b show the active duty grade or rank and pay grade at time of separation and are obtained from the Soldier's records (promotion or reduction orders). The grade or rank in which he is serving on the date when his name is placed on the temporary disability retired list or, if his name was not carried on that list, on the date when he is retired. There is no evidence in his records and he provides...

Application for correction of military records (with supporting documents provided, if any). If his year of birth had been 1969 he would have been 15 years of age at the time of his enlistment in the USAR. Therefore, there is sufficient evidence to correct his DD Form 214 to show his year of birth as 1962.
ARMY | BCMR | CY2013 | 20130019376
The applicant requests correction of the type of separation shown on his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 25 September 1992 to show release from active duty (REFRAD) instead of release from active duty for training (ADT). Chapter 2 states item 23 shows the type of separation for enlisted personnel, such as REFRAD, discharge, retirement, release from ADT, or release from custody and control of the Army. Upon his REFRAD, his DD Form 214...

Application for correction of military records (with supporting documents provided, if any). The applicant requests correction of his records to show he completed 20 years of qualifying service for retired pay at age 60. Therefore, there is no basis for correcting his records to show he completed 20 years of qualifying service for retired pay at age 60.

His records do not show he served in Vietnam during this period of active service. Army Regulation 600-8-22 (Military Awards) states the Vietnam Service Medal was awarded to all members of the Armed Forces of the United States for qualifying service in Vietnam after 3 July 1965 through 28 March 1973. There is also no evidence to show he completed a qualifying period of service for award of the Vietnam Service Medal.
