THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of the Social Security Number (SSN) shown on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to list the last digit of SSN as "4."
2. He states the SSN as listed on his DD Form 214 is incorrect.
3. The applicant provides his DD Form 214 and letter orders.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. He was inducted into the Army of the United States on 21 March 1968. The DD Form 47 (Record of Induction) that was completed at the time shows his SSN with "4" as the last digit.
3. The applicant's record contains a DD Form 1584 (National Agency Check Request) and DA Form 20 (Enlisted Qualification Record), page 1 that show "4" as the last digit of his SSN.
4. The applicant was released from active duty on 23 October 1969 and transferred to the U.S. Army Reserve (USAR). His DD Form 214 shows his SSN with the last digit as "3."
5. He provided Letter Orders Number 02-1055273, dated 27 February 1974, which discharged him from the USAR. These orders show his SSN with "4" as the last digit.
DISCUSSION AND CONCLUSIONS:
A majority of the documents in his personnel record list his SSN with "4" as the last digit. Therefore, it would be appropriate to correct his DD Form 214 to show his correct SSN.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting from his DD Form 214 the current SSN listing and replacing it with the SSN as shown on his DD Form 47.

The evidence of record shows that subsequent to the applicant's release from active duty, his SSN was found to be incorrectly recorded in his military personnel records as "XXX-XX-XXX9" and it was to be corrected to "XXX-XX-XXX6."
