THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests the DD Form 214 (Certificate of Release or Discharge from Active Duty) of his deceased father, a former service member (FSM), be corrected to show the:

* Meritorious Service Medal
* Army Commendation Medal (1st Oak Leaf Cluster (OLC))
* Vietnam Service Medal with 6 bronze service stars
* Overseas Service Ribbon (4th Award)
* Sharpshooter Marksmanship Qualification Badge with Rifle Bar (M-16)
* Master Aviator (instead of Aviation) Badge
* Korea Defense Service Medal

2.  The applicant states, in effect, his father's DD Form 214 does not reflect all his awards and decorations.  

3.  The applicant provides his birth certificate and the FSM's:

* Death certificate
* DD Form 214
* General Orders (GO) Number 1113 (Air Medal with "V" Device)
* DA Form 2-1 (Personnel Qualification Record)
* Permanent Orders (PO) 196-5 (Meritorious Service Medal)
* PO 11-16 (amendments)
* GO Number 246 (Army Commendation Medal (1st OLC))
* Special Orders Number 23 (Aeronautical Badge)
CONSIDERATION OF EVIDENCE:

1.  The FSM previously served in an enlisted status in the Army National Guard, U.S. Air Force, U.S. Army Reserve (USAR), and the Regular Army.  He also served as a commissioned officer in the USAR.  

2.  He was appointed as aviation warrant officer on 24 October 1963.  He entered active duty on 9 December 1963.  He served in a variety of stateside or overseas assignments and he was promoted to chief warrant officer four (CW4).  

3.  He completed the following periods of foreign service and received overseas tour credit for each area/country: 

	a.  Vietnam, from 10 March 1965 to 9 March 1966.  He was assigned to the 120th Aviation Company (12 March 1965 to 3 May 1965) and Company A, 82nd Aviation Battalion (4 May 1965 to 9 March 1966).

	b.  Vietnam, from 9 September 1967 to 1 August 1968.  He was assigned to the 138th Aviation Company.

	c.  Germany, from 11 September 1968 to 6 January 1976 (two consecutive tours).

	d.  Korea, from 26 April 1981 to 16 April 1982. 

4.  He retired on 3 December 1982 by reason of permanent physical disability.  His DD Form 214 shows he was awarded or authorized the:

* Republic of Vietnam Campaign Medal
* National Defense Service Medal (1st OLC)
* Distinguished Unit Citation
* Army Commendation Medal
* Republic of Vietnam Gallantry Cross with Palm

* Armed Forces Reserve Medal
* Air Medal with "V" Device
* Republic of Vietnam Gallantry Cross with Palm Unit Citation
* Master Army "Aviation" Badge
* Humanitarian Service Medal
* Overseas Service Ribbon
* Armed Forces Reserve Medal with X Device

5.  His records contain and/or the applicant provides: 

	a.  PO Number 196-5, issued by Headquarters, U.S. Army Air Defense Center, Fort Bliss, TX, on 30 December 1982, awarding him the Meritorious Service Medal. 

	b.  GO Number 62, issued by the U.S. Army Aviation Center, Fort Rucker, AL, on 7 August 1967, awarding him the Army Commendation Medal

	c.  GO Number 246, issued by Headquarters, 5th Signal Command, on 
4 December 1975, awarding him the Army Commendation Medal (1st OLC).

	d.  SO Number 23, issued by Headquarters, U.S. Army Europe and 7th Army, on 23 January 1974, awarding him the Master Aviator Badge.

6.  The FSM's DA Form 2-1 shows he qualified sharpshooter with the M-16 rifle in July 1967. 

7.  Army Regulation 600-8-22 (Military Awards) states:

	a.  The Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who have served on active duty in support of the defense of the Republic of Korea.  The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense

	b.  The Overseas Service Ribbon was established by the Secretary of the Army on 10 April 1981.  Effective 1 August 1981, all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status are eligible for the award for successful completion of overseas tours.  The award may be awarded retroactively to those personnel who were credited with a normal overseas tour completion before 1 August 1981 provided they had an Active Army status on or after 1 August 1981.  Numerals are used to denote the second and subsequent awards of the Overseas Service Ribbon.  Tour length for Germany is 24 months (without dependents) or 36 months (with dependents). 

	c.  Appendix B of Army Regulation 600-8-22 shows that during his service in Vietnam (10 March 1965 to 9 March 1966 and 9 September 1967 to 1 August 1968), participation credit was awarded for the below campaigns.  This same regulation states that a bronze service star will be awarded for wear on the Vietnam Service Medal for participation in each campaign.  A silver service star denotes five bronze service stars. 
* Vietnam Defense Campaign, 8 March - 24 December 1965
* Vietnam Counteroffensive, 25 December 1965 - 30 June 1966
* Vietnam Counteroffensive Phase III, 1 June 1967 - 29 January 1968
* Tet Counteroffensive, 30 January - 1 April 1968
* Vietnam Counteroffensive Phase IV, 2 April - 30 June 1968
* Vietnam Counteroffensive Phase V, 1 July - 1 November 1968

	d.  There are three degrees of the aviator badges authorized for the Army Aviator Badge: (1) Basic Army Aviator Badge; (2) Senior Army Aviator Badge; and (3) Master Army Aviator Badge.

8.  Department of the Army (DA) Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the awards received by units serving in Vietnam.  This pamphlet shows during his service with Company A, 82nd Aviation Battalion, from 4 May 1965 to 9 March 1966, this unit was cited for award of the Meritorious Unit Commendation, for service from 1 May 1965 to 31 July 1966 by DAGO Number 17, dated 1968.

DISCUSSION AND CONCLUSIONS:

1.  PO awarded the FSM the Meritorious Service Medal which is not shown on his DD Form 214.  Therefore, he is entitled to correction of his DD Form 214 to show this award. 

2.  GO awarded the FSM two awards of the Army Commendation Medal.  Only one award is shown on his DD Form 214.  Therefore, he is entitled to correction of his DD Form 214 to show both awards. 

3.  The FSM served a qualifying period of service for award of the Korea Defense Service Medal.  Therefore, he is entitled to correction of his DD Form 214 to show this award. 

4.  The FSM was awarded the Vietnam Service Medal.  Additionally, he participated in six campaigns while serving in Vietnam; therefore, he is entitled to award of one silver and one bronze service stars to be affixed to his already-awarded Vietnam Service Medal.

5.  GO awarded his unit in Vietnam the Meritorious Unit Commendation which is not shown on his DD Form 214.  Therefore, he is entitled to correction of his DD Form 214 to show this unit award. 

6.  The FSM qualified sharpshooter with the M-16 rifle.  Therefore, he is entitled to correction of his DD Form 214 to show the Sharpshooter Marksmanship Qualification badge with Rifle Bar (M-16). 

7.  The FSM was awarded the Master Aviator Badge.  This badge was inadvertently listed as the Master Aviation Badge.  His DD Form 214 should be corrected to reflect the correct name of this badge. 

8.  The FSM received overseas tour credit for two tours in Vietnam, one tour in Korea, and one tour in Germany.  He also had an active status after April 1981.  His Germany tour lasted 88 months which constituted two consecutive overseas tours.  Therefore, the FSM, in effect, completed five overseas tours and is entitled to five awards of the Overseas Service Ribbon and correction of his DD Form 214 accordingly.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* deleting from his DD Form 214 for the period ending 3 December 1982 the Army Commendation Medal, Vietnam Service Medal, Master Army Aviation Badge, and Overseas Service Ribbon (1)
* adding to his DD Form 214 the:

* Meritorious Service Medal
* Army Commendation Medal (2nd Award)
* Korea Defense Service Medal
* Vietnam Service Medal with one silver and one bronze service star
* Meritorious Unit Commendation


* Sharpshooter Marksmanship Qualification Badge with Rifle Bar (M-16)
* Master Army Aviator Badge
* Overseas Service Ribbon (5th Award)
