THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of the social security number (SSN) shown on his DD Form 214 (Certificate of Release or Discharge from Active Duty).

2.  The applicant states the SSN shown on his DD Form 214 is incorrect.

3.  The applicant provides copies of his DD Form 214 and social security card.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a 
substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  On 15 January 1970, the applicant completed a DD Form 398 (Statement of Personal History) in connection with his enlistment.  In item 13 (Employment), he entered his SSN as XXX-XX-X994.

3.  On 19 January 1970, the applicant enlisted in the Regular Army.  His enlistment documents show his SSN as XXX-XX-X844.

4.  On 24 January 1972, he was honorably released from active duty.  His DD Form 214 shows his SSN as XXX-XX-X844.

5.  The SSN shown on his DA Form 20 (Enlisted Qualification Record) has a typed entry that shows his SSN as XXX-XX-X844 that was lined through and  changed to show his SSN as XXX-XX-X99X.  Multiple other documents in his military personnel record show this same SSN.

6.  He provides a copy of a social security card showing his SSN as 
XXX-XX-X994.

DISCUSSION AND CONCLUSIONS:

1.  His enlistment documents and his DD Form 214 show his SSN as 
XXX-XX-X844.

2.  The copy of a social security card that he provides, his DA Form 20, and multiple other documents in his military personnel record show his SSN as 
XXX-XX-X994.  Therefore, it appears this SSN was initially entered incorrectly in his records and was later changed to reflect that SSN as shown on the copy of the social security card he provides.  It was then entered on his DD Form 214 as shown on his enlistment documents.

3.  In view of the foregoing, it would be appropriate to correct his DD Form 214 to show the SSN shown on his social security card.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the current SSN entry from his DD Form 214 and replacing it with the SSN as shown on his social security card.
