THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Army Superior Unit Award (ASUA) and Meritorious Unit Commendation (MUC).

2.  The applicant makes no additional statement.

3.  The applicant provides:

* U.S. Army Human Resources Command (HRC), Fort Knox, KY, Permanent Order 126-04, dated 6 May 2013
* HRC, Fort Knox, KY, Permanent Order 137-06, dated 17 May 2013

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 29 May 2002.

2.  Section IX (Assignment Information) of the applicant's Enlisted Record Brief shows he was assigned to:

* Headquarters, V Corps, Germany, from 22 December 2010 to 31 July 2011
* Headquarters and Headquarters Battalion (HHB) and Headquarters Support Company (HSC), V Corps, Germany, from 1 August 2011 to 9 April 2012
* Headquarters Company Rear Detachment, V Corps, Germany, from 10 April 2012 to 21 January 2013

3.  HHB, V Corps, Permanent Order 230-13, dated 18 August 2011, awarded him the Army Good Conduct Medal (3rd Award) for the period 29 May 2008 through 28 May 2011.  These orders show he was assigned to HHB and HSC, V Corps.

4.  An HHB (Rear) (Provisional), V Corps, memorandum for record, dated 29 October 2012, subject:  Counseling Statement, shows the applicant elected to be medically separated from the Army on 21 January 2013.

5.  The applicant's DD Form 214 shows he was honorably discharged on 21 January 2013 based on disability with severance pay.  He completed 10 years, 7 months, and 23 days of total active service that included 5 years, 11 months, and 19 days of foreign service.  It also shows he was awarded or authorized the:

* Iraq Campaign Medal with four campaign stars
* Army Commendation Medal (4th Award)
* Army Achievement Medal
* U.S. Army/U.S. Air Force Presidential Unit Citation
* Army Good Conduct Medal (3rd Award)
* National Defense Service Medal
* Global War on Terrorism Expeditionary Medal
* Global War on Terrorism Service Medal
* NCO Professional Development Ribbon
* Army Service Ribbon
* Overseas Service Ribbon (4th Award)
* Military Outstanding Volunteer Service Medal
* Driver and Mechanic Badge with Driver-Wheeled Vehicle Clasp

6.  The applicant provided HRC Permanent Order 126-04, dated 6 May 2013, which shows HHB, V Corps, Germany, was awarded the ASUA for exceptionally meritorious service during the period 16 April 2011 to 10 May 2012 prior to V Corps Headquarters' deployment to Afghanistan.

7.  The applicant provided HRC Permanent Order 126-04, dated 17 May 2013, which shows HHB, V Corps, was awarded the MUC for exceptionally meritorious service during the period 12 June 2012 to 2 May 2013 as the core and framework unit in the International Security Assistance Force Joint Command and also as experts in the V Corps Headquarters, U.S. Forces-Afghanistan, Joint Task Force 435, Combined Security Transition Command-Afghanistan, North Atlantic Treaty Organization Training Mission-Afghanistan, Regional Commands, National Support Elements, and Headquarters Support Elements.

DISCUSSION AND CONCLUSIONS:

1.  The applicant requests correction of his DD Form 214 to show award of the ASUA and MUC.

2.  The applicant was awarded the Army Good Conduct Medal while he was assigned to HHB and HSC, V Corps, Germany, during the same period his unit was cited for award of the ASUA.  Therefore, his DD Form 214 should be corrected to show award of the ASUA.

3.  Although he was assigned to HHB, V Corps, during the period the unit was awarded the MUC, he was assigned to the rear detachment which was not cited in the orders.  Therefore, he is not authorized this award.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding award of the ASUA to his DD Form 214.

2.  The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so 


much of the application that pertains to adding award of the MUC to his DD Form 214.
