		IN THE CASE OF:

		BOARD DATE: 3 June 2014

		DOCKET NUMBER: AR20130017942

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his award of the Combat Infantryman Badge (CIB).

2. The applicant states he was awarded the CIB overseas and he did not ensure the CIB was entered on his DD Form 214.

3. The applicant provides his:

* DD Form 214
* Army Commendation Medal (ARCOM) Certificate
* Soldier Deployment History Out-processing Report

CONSIDERATION OF EVIDENCE:

1. The applicant's records show he enlisted in the Regular Army on 22 July 2008. He completed basic combat and advanced individual training and was awarded military occupational specialty (MOS) 11B (Infantryman).

2. On 17 November 2011, he was released from active duty after serving honorably for 3 years, 3 months, and 26 days. His DD Form 214 does not show award of the CIB.

3. There are no orders in the available records that show he was awarded the CIB. Additionally, there is no evidence that he personally engaged in active ground combat while he was in Iraq.

4. He submitted:

	a. an ARCOM Certificate showing Headquarters, Task Force Wings, Permanent Order Number 092-243, dated 2 April 2010, awarded him the ARCOM for meritorious service while serving as an infantry rifleman for the 2d Battalion, 25th Aviation Regiment, in support of Operation Iraqi Freedom from 22 October 2009 to 22 October 2010; and

	b. his Soldier Deployment History Out-processing Report, dated 21 October 2011, showing he was deployed in support of a contingency operation from 15 October 2009 to 1 October 2010.

5. Army Regulation 600-8-22 (Military Awards) states there are basically three requirements for award of the Combat Infantryman Badge. The Soldier must be an infantryman satisfactorily performing infantry duties, he must be assigned to an infantry unit during such time as the unit is engaged in active ground combat, and he must actively participate in such ground combat.

DISCUSSION AND CONCLUSIONS:

The available evidence shows the applicant held an infantry MOS and served as an infantry rifleman while assigned to an aviation unit. However, there is no evidence showing he personally engaged in active ground combat while serving in an infantry unit. Therefore, there is insufficient evidence to add the CIB to his DD Form 214.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

____X____ ____X____ ____X____ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

The case provided by the applicant’s counsel (AR2002068627) which he contends sets a precedent by the Board involves the award of the CIB to a Soldier who served as an infantryman but held another MOS through on-the job training and because he had never been school trained in any MOS and had served the majority of his time in an infantry MOS, the Board awarded the Soldier the CIB. While there is no dispute that the applicant was assigned to an infantry unit and performed infantry duties,...
