THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests retroactive payment of Health Professions Officer Incentive Pay (HPOIP) for the period 31 August 2011 through 30 September 2013.

2.  The applicant states, in effect, she did not receive HPOIP for the period 31 August 2011 through 30 September 2013 because her requests were not properly submitted and processed by the Army Medical Department Special Pay Branch despite the fact that she met all criteria for payment. 

3.  The applicant provides copies of her veterinary license and permanent change of station orders transferring her to Francis E. Warren Air Force Base, Wyoming.

CONSIDERATION OF EVIDENCE:

1.  The applicant was appointed as a Regular Army Veterinary Corps captain on 13 June 2010 and was ordered to active duty on 14 June 2010.  She was assigned to Hawaii for her first duty station and was transferred to Francis E. Warren Air Force Base, Wyoming, effective 1 July 2013.

2.  In the processing of this case a staff advisory opinion was obtained from the Office of the Surgeon General (OTSG) Special Pay Branch which states the applicant received HPOIP for the period 31 August 2010 through 30 August 2011.  However, there are no records of HPOIP contracts for the period 31 August 2011 through 30 September 2013, a period in which she was eligible to receive $2,500.00 per year payable at $208.33 per month.  The advisory opinion was provided to the applicant for comment.  To date, no response has been received by the Board staff.

DISCUSSION AND CONCLUSIONS:

1.  Although the applicant has not provided copies of her applications for HPOIP for the period 31 August 2011 through 30 September 2013, she performed the duties of veterinarian and was eligible to receive the pay.

2.  Additionally, the advisory opinion from OTSG states she was eligible to receive $2,500.00 per year payable at $208.33 per month for the period 31 August 2011 through 30 September 2013.

3.  Therefore, as a matter of equity, the applicant’s record should be corrected to show she submitted her contracts to OTSG for HPOIP for the period 31 August 2011 through 30 September 2013 in a timely manner.  

4.  Accordingly, OTSG should accept and authorize retroactive payments of HPOIP for the period 31 August 2011 through 30 September 2013.

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  showing she timely submitted her applications for HPOIP for the period 31 August 2011 through 30 September 2013,

	b.  showing the appropriate office timely received and processed her applications for HPOIP for the period 31 August 2011 through 30 September 2013, and

	c.  paying her HPOIP for the period 31 August 2011 through 30 September 2013 as a result of these corrections.
