THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests authorization to receive Health Professional Loan Repayment (HPLR).

2.  The applicant states the North Carolina Army National Guard (NCARNG) Medical Specialty Branch recruiter, First Lieutenant (1LT) B------, offered him the HPLR.  He submitted the application and the required documentation and was repeatedly assured that everything was in order.  When his first annual payment was not received he contacted the new branch recruiter and was told that the documentation had not been forwarded and that he would not receive the HPLR.

3.  The applicant provides:

* Memorandum for Record, dated 14 September 2013
* USAREC Form 1252 (US Army Reserve and Army National Guard Incentives Declaration Statement)

CONSIDERATION OF EVIDENCE:

1.  The applicant, having served in the ARNG as a Medical Service Corps officer while in school, received his doctorate and his North Carolina dental license and was appointed a captain in the NCARNG.  He was granted temporary Federal recognition with a date of rank of 18 May 2012. 


2.  The applicant provided a USAREC Form 1252 that shows he desired to accept the HPLR.  This document was electronically signed by the applicant on 10 September 2012, but not by the recruiter.

3.  In the 14 September 2013 Memorandum of Record the applicant submitted in support of his request 1LT B------ confirmed that he had offered the applicant the HPLR and found him qualified.  Unfortunately, he had neglected to sign and submit the document.  He thought it unjust that the applicant was being deprived of a benefit because of something that was beyond his control.  

4.  The National Guard Bureau provided an advisory opinion.  The Chief, Personnel Policy Division recommended approval of the request.  She noted that the available evidence supported the applicant's description of events and recommended that the state correct the USAREC Form 1252 to show that it was signed and dated on 10 September 2012.

5.  The NCARNG concurred with the recommendation.

6.  The advisory opinion was provided to the applicant for his concurrence or comment.  He did not respond.

7.  Title 10, U.S. Code, section 16302 provides for the repayment of health professional educations loans for properly-qualified health care professionals who serve in the Selected Reserve.  Recipients must have been first appointed a commissioned officer on or before 31 December 2013. 

DISCUSSION AND CONCLUSIONS:

1.  The applicant was qualified and applied for the HPLP.  It was promised to him but he did not receive it due to an administrative oversight. 

2.  The NGB recommended that the record be corrected to authorize the applicant to receive the HPLP.  This recommendation should be accepted.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army and State Army National Guard records of the individual concerned be corrected by showing that USAREC Form 1252 was signed by the North Carolina Specialty Branch recruiter on 10 September 2012 and that it was timely submitted by the NCARNG and that his loans be paid out of ARNG funds.
