IN THE CASE OF:
BOARD DATE: 14 May 2014
DOCKET NUMBER: AR20130016595
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, correction of his social security number (SSN) on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) with an effective date of 25 June 1971.
2. The applicant states the last four numerals of his SSN are wrong. He entered his SSN on his request with the last four numerals as "1904."
3. The applicant provides no additional evidence in support of his application.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. On 5 September 1968, he enlisted in the Regular Army. Item 19 (SSAN) of his DD Form 4 (Enlistment Contract - Armed Forces of the United States) shows his SSN with the last four numerals as "1904."
3. His enlistment orders identify him with the SSN with the last four numerals
as "1904."
4. His DA Form 20 (Enlisted Qualification Record) shows his SSN with the last four numerals as "1904."
5. Documents throughout his Military Personnel Records Jacket (MPRJ) identify him using his SSN with the last four numerals as "1904."
6. On 25 June 1971, he was released from active duty. Item 3 (Social Security Number) of his DD Form 214 shows his SSN with the last four numerals
as "1004."
7. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The regulation directs that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge. It is important that information entered on the form be complete and accurate and reflects the conditions as they existed at the time of separation.
DISCUSSION AND CONCLUSIONS:
Entries on his DD Form 4, enlistment orders, DA Form 20 and documents throughout his MPRJ show his SSN with the last four numerals as "1904." There was clearly a typographical error when his SSN was entered on his DD Form 214 with an effective date of 25 June 1971. Therefore, it is appropriate to correct item 3 of his DD Form 214 to show his SSN as it is shown in item 19 of his
DD Form 4.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the SSN from item 3 of his DD Form 214 with an effective date of
25 June 1971 and adding the SSN as it is shown on his DD Form 4, dated
5 September 1968.

The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) with an effective date of 2 March 1971 to show the last numeral of his social security number (SSN) as a "4" instead of a "5." His orders separating him from active duty show his SSN with the last numeral as a "4." Entries on his DD Form 47, induction orders, orders for release from active duty, and documents throughout his MPRJ show his SSN with the last numeral as a "4."

The following documents in his Military Personnel Records Jacket (MPRJ) show his SSN with the last four numerals "0882" and his DOB with the year 1950: * DD Form 398 (Statement of Personal History) * DD Form 1584 (National Agency Check Request) * DA Form 41 (Record of Emergency Data) 4. The DD Form 398 was completed by the applicant and he entered his DOB with the year 1950. On 22 June 1971 in preparation for his upcoming enlistment in the Regular Army, the applicant completed a fingerprint card and police record check form wherein he recorded his SSN as "XXX-XX-5150" and his place of birth as "Asswan [sic], Israel." He provides: * a printout from the VBA which identifies his SSN as "XXX-XX-5150" * a letter from the Social Security Card Center, Brooklyn, NY, dated 25 February 2013, which states he was issued the requested SSN, "XXX-XX-5029," and erroneously...

The applicant requests his date of birth (DOB) and social security number (SSN) be corrected on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) with an effective date of 30 September 1968. His DA Form 20 (Enlisted Qualification Record) shows his SSN with the last four numerals "51x6" and his DOB as 31 August 1948. Therefore, there is sufficient evidence to correct his DD Form 214 to show his DOB as 31 August 1948.
ARMY | BCMR | CY2014 | 20140001386
The applicant requests his military records be corrected to show the last four numerals of his social security number (SSN) as "2882" instead of "5219." However, the evidence he submitted is dated 7 January 2014, which is more than 20 years after his retirement. Therefore, there is insufficient evidence to change the SSN recorded in his military records.

Item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows he was awarded or authorized to wear the: * National Defense Service Medal * ARCOM * Vietnam Service Medal (VSM) * AM * Vietnam Campaign Medal [properly known as the Republic of Vietnam Campaign Medal with Device (1960)] * BSM 10. As a result, it would be appropriate to award him the AGCM for his qualifying period of honorable active service from 22 January...

Application for correction of military records (with supporting documents provided, if any). Item 3 of his DD Form 214 lists the last four digits of his SSN as "4313." He now submits an SSN card that confirms that the last four digits of his SSN are 4531. As a result, Item 3 of the applicants DD Form 214 should be corrected accordingly.

The DD Form 214 issued to him at that time contains the number 5 as the last digit of his SSN. The evidence of record confirms the SSN under which the applicant entered active duty and under which he performed his active duty service contains the number 5 as the last digit, and not the number 9 as listed on his BSM order, certificate, and citation. The SSN entered on the DD Form 47 prepared on him during induction, the DA Form 20 prepared on him upon his entry on active duty, and the...
