THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests award of additional constructive service credit for his work as a physician during his break in service.
2. The applicant states, in effect, that he does not believe he was granted the appropriate amount of constructive service credit for his work as a physician during his break in service. He believes he should have been awarded 5 years, 1 month, and 30 days of constructive service credit.
3. The applicant provides a list of enclosures with his application in the form of a one-page letter.
CONSIDERATION OF EVIDENCE:
1. The applicant served in the U.S. Air Force Reserve (USAFR) from 21 March 1996 to 7 June 2000 and on 8 June 2000 he entered active duty in the U.S. Air Force (USAF). He served in the Regular Air Force (REGAF) as a psychiatrist and was promoted to the rank of major on 26 May 2006. He continued to serve until he resigned his commission on 1 October 2009.
2. On 22 April 2013, the applicant was commissioned as a U.S. Army Reserve (USAR) Medical Corps major on 22 April 2013 and was assigned to a troop program unit. He was granted 4 years credit for his medical degree, 9 years, 4 months and 5 days constructive credit for his prior Air Force service and 1 year, 8 months, and 27 days for professional experience for a total of 15 years, 1 month, and 2 days constructive service credit. The maximum allowed is 14 years unless a waiver is granted for additional constructive service credit.
3. In the processing of this case a staff advisory opinion was obtained from the U.S. Army Recruiting Command (USAREC) at Fort Knox, Kentucky which opines that the applicant was granted one-half credit for his professional experience during his break in service (2 October 2009 through 26 March 2013, his USAREC board date) and is not entitled to additional credit. The advisory opinion was provided to the applicant for comment and to date no response has been received by the staff of the Board.
4. Department of Defense Instruction (DODI) 6000.13 (Medical Manpower and Personnel) provides, in pertinent part, that credit for one-half year for each year of experience up to a maximum of three years of constructive credit may be granted for experience in a health profession if such experience is directly used by the Military Service concerned.
DISCUSSION AND CONCLUSIONS:
1. The applicants contention that he is entitled to additional constructive service credit for his professional experience during his break in service has been noted and appears to lack merit.
2. The applicant was granted one-half credit for his professional experience during his break in service which totaled 1 year, 8 months and 27 days. It is also noted that the maximum constructive credit allowed for an officer not ordered to active duty is 14 years and the applicants total entry grade credit amounted to 15 years, 1 month, and 2 days.
3. The subject matter experts (USAREC) have reviewed the applicants case and determined that the amount of credit awarded the applicant upon his appointment in the USAR is correct and there does not appear to be any reason to believe that office is inconsistent in its recommendation to the Board, especially since the applicant was provided the opinion and has made no response to the explanation provided by USAREC.
4. Accordingly, there appears to be no error or injustice in his case and no basis to grant his request for additional constructive service credit.
