THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests payment of a $10,000.00 Officer Accession Bonus (OAB).
2. The applicant states:
a. He was denied the OAB because the paperwork was not signed and correctly completed by the certifying officials. Additionally, officials are claiming the bonus was denied because his position was not bonus eligible. He was told by multiple persons that the position was eligible. The position listing changed military occupational specialty (MOS) identification numbers several months after his paperwork was completed. He believes this change also contributed to his bonus denial.
b. He believes there was an injustice done which was caused by an error on the part of the Certifying Officials who dealt with the bonus paperwork. Those officials did not properly complete and sign the bonus paperwork as they were supposed to.
c. Prior to graduating from the Warrant Officer Basic Course (WOBC) in August 2011, he met with the Deputy Commandant at the Warrant Officer Career College (WOCC) who contacted the bonus and accession office to confirm the applicant's eligibility for a bonus. These officials indicated the applicant was eligible for the bonus providing he filled the slot at the 110th Information Operations Forward Support Battalion which he fulfilled upon graduation from his WOCS course. This slot was listed as critical when he signed the paperwork.
d. It is an injustice that his bonus paperwork did not include the required signatures. The persons responsible for signing the documents did not do their due diligence. Additionally there was a change from MOS 251A (which It was called at the time he filled out the bonus paperwork and completed WOCS) to 255A (what it was changed to by the time of his graduation from WOBC in August of 2012). This also created confusion once the paperwork was submitted and may have affected the position listing as critical or not but this was done following the completion of the paperwork and his graduation from the candidates course. The form was submitted with no signatures as an exception to policy.
3. The applicant provides:
* A National Guard Bureau (NGB) memorandum, dated 27 March 2012, denying an exception to policy (ETP)
* Email exchanged between him and the NGB Deputy Commandant, ARNG Warrant Officer Career College
CONSIDERATION OF EVIDENCE:
1. With prior enlisted service in the Maryland Army National Guard (MDARNG), the applicant executed an oath of office and was appointed as a Reserve Warrant Officer (WO1) effective 3 August 2011 in the MDARNG. He completed the Information Systems Technician WOBC on 3 August 2012.
2. In support of his request the applicant provided:
a. A 2 August 2011 email note in which the Deputy Commandant, USA WOCC states "I just called and talked to the 1st WOC you are qualified for the Bonus. Please stop by my office at 0650 tomorrow morning and we will print out the documents and have you sign them before you take the oath."
b. A 27 March 2013 NGB memorandum, subject: Request for ETP for OAB which states the applicant's request to retain the $10,000 OAB was denied and that the State Incentive Manager would terminate with recoupment. The memorandum further reveals the applicant's critical skill could not be validated as an authorized critical skill and that the contract/bonus addendum was missing signatures and dates from the Witnessing Official and the Service Representative.
3. His record does not contain any documents showing he contracted for an OAB.
DISCUSSION AND CONCLUSIONS:
1. There is no available evidence showing the applicant executed a contract for the OAB.
2. In view of the foregoing, there is an insufficient evidentiary basis for granting the applicant's requested relief.
