IN THE CASE OF:
BOARD DATE: 13 May 2014
DOCKET NUMBER: AR20130016183
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his date of birth (DOB) as 4 March 1949 instead of 3 April 1949.
2. The applicant states the DOB shown in item 9 (DOB) of his DD Form 214 is incorrect. The day and month fields have been transposed.
3. The applicant provides copies of his birth certificate and DD Form 214.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant's DD Form 398 (Statement of Personal History), dated 31 July 1968, shows his DOB as 4 March 1949. He was inducted into the Army of the United States on 27 August 1968.
3. His DD Form 1584 (National Agency Check Request), dated 9 September 1968, shows his DOB as 4 March 1949.
4. He served as a light weapons infantryman in Vietnam from 1 March 1969 to 28 February 1970 and he was honorably released from active duty on 23 June 1970.
5. Item 9 of his DD Form 214 shows his DOB as 3 April 1949.
6. He provided his birth certificate which shows he was born on 4 March 1949.
DISCUSSION AND CONCLUSIONS:
The applicant contends the day and month fields shown on his DD Form 214 are transposed. His DD Form 398 and DD Form 1584 support his contention. Based on the foregoing, it would be appropriate to correct item 9 of his DD Form 214 to show his DOB as 4 March 1949.
BOARD VOTE:

BOARD DETERMINATION/RECOMMENDATION:
The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by
deleting the current entry in item 9 of his DD Form 214 and replacing it with the entry "4 Mar 49."

The applicant requests correction of his DD Form 214 (Report of Separation from Active Duty) to show his date of birth (DOB) as 15 XXXX 1939 instead of 14 XXXX 1949. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. His service record contains the following documents which show his DOB as...

Application for correction of military records (with supporting documents provided, if any). The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his date of birth (DOB) as 28 August 1949 instead of 28 October 1949. Army Regulation 635-5 (Separation Documents) states that the DD Form 214 is a summary of a Soldier's most recent period of continuous active duty.

Application for correction of military records (with supporting documents provided, if any). His record contains a DD Form 398 (Statement of Personal History), dated 13 January 1968, that shows he recorded his DOB as 12 March 1947 in item 5 (DOB). As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Forms 214 for the periods ending 7 January and October 1970 to show his DOB as 12 March 1947 as it appears on...

The applicant's service records show: * a DD Form 47 (Record of Induction) shows his DOB as 7 June 1949 * a DD Form 398 (Statement of Personal History) which he completed during his induction processing shows his DOB as 7 June 1949 * item 9 (DOB) of his DD Form 214 shows the DOB 6 July 1949 5. The applicant has requested correction of his DD Form 214 to show the DOB 6 June 1949 (sic). ARMY | BCMR | CY2009 | 20090012753
The applicant's records contain a copy of his DD Form 41 (Record of Emergency Date) that shows his DOB as "6 June 1949." In the absence of documentation that conclusively shows he was wounded or injured as a result of hostile action and treated for those wounds, there is insufficient evidence upon which to base award of the Purple Heart in this case. With respect to his DOB, the evidence of record shows that his induction document and one of his DA Forms 20 listed his DOB as 2 June 1949.
ARMY | BCMR | CY2013 | 20130005969
His military records are void of orders or any other document that indicate he was recommended for or awarded the CIB. Therefore, his DD Form 214 should be corrected to show his correct DOB. Evidence shows he was awarded MOS 11B while in Vietnam.
ARMY | BCMR | CY2011 | 20110016977
His service personnel records show his DOB as 12 June 1949 and 12 July 1949. The evidence of record shows the applicant's DOB as 12 July 1949 at the time of his induction. _______ _ X _______ ___ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.

He served in Vietnam during the period 17 August 1970 to 25 February 1972 and his DD Form 214 shows only 6 months and 9 days of foreign service. The DD Form 4 (Enlistment Record Armed Forces of the United States) and DD Form 398 (Statement of Personal History) completed during his enlistment processing lists his DOB as 7 October 1946. The evidence of record shows at the time he entered the Army, his DOB was listed as 7 October 1946, and his military record contains official documents which list this same DOB. Therefore, it would be appropriate at this time to correct his DD Form 214 to show his DOB as shown on his Certificate of Birth.
