THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of the Social Security Number (SSN) shown on his DD Form 214 (Report of Transfer or Discharge).

2.  The applicant states the SSN is recorded wrong.

3.  The applicant provides copies of his Social Security Card showing the second and third digits of his SSN are "61" and his DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  The applicant served in the Regular Army from 31 August 1966 to 
15 September 1969.

3.  When the applicant enlisted in the Regular Army Soldiers were identified by a service number.  The SSN did not come into widespread usage until later.

4.  The applicant's available record contains various documents that list both the SSN listed on his DD Form 214 and the SSN that is listed on his social security card, including the following documents that list the SSN that is listed on his social security card. 

a.  DD Form 398 (Statement of Personal History), which he completed 
in order to obtain a security clearance. 

   b.  DA Form 41 (Record of Emergency Data), dated 31 August 1966.
   
   c.  DA Form 348 (Equipment Operators Qualification Record), issued on 
18 March 1969. 

DISCUSSION AND CONCLUSIONS:

1.  It appears an error occurred in the listing of the SSN on the applicant's 
DD Form 214 when the document was prepared.

2.  The applicant's DD Form 398 lists the SSN that is listed on his social security card which he claims is correct.  In accordance with his request his DD Form 214 should be corrected to show this SSN.
