THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as XXX-XX-5016 and his date of birth (DOB) as 27 November 1948.

2.  The applicant states the SSN and DOB shown on his DD Form 214 are incorrect.  He states his correct SSN is XXX-XX-5016 and his correct DOB is 27 November 1948.

3.  The applicant provides copies of his DD Form 214, birth certificate, and social security card.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 25 July 1968 for a period of 2 years.  At the time of his enlistment he recorded his SSN as XXX-XX-4396 and indicated his DOB was 28 November 1949.

2.  He completed basic training at Fort Knox, Kentucky, and advanced individual training as an infantry indirect fire crewman at Fort Polk, Louisiana, before being transferred to Vietnam on 22 December 1968.

3.  He departed Vietnam on 21 December 1969 and was transferred to Fort Lewis, Washington, where he remained until he was honorably released from active duty on 24 July 1970.  His DD Form 214 shows his SSN as 
XXX-XX-4396, the same SSN under which he served his entire period.  However, his year of birth was entered as 1969 instead of 1949.

4.  The birth certificate provided by the applicant was issued in 2007 and shows his DOB as 27 November 1948.  His social security card shows his SSN as 
XXX-XX-5016.

5.  Army Regulation 635-8 (Separation Processing and Documents) serves as the authority for preparation of the DD Form 214.  It provides that the DD Form 214 will be prepared to reflect information as it exists in the official records at the time of separation.

DISCUSSION AND CONCLUSIONS:

1.  A review of the applicant's official records shows he served his entire period under the SSN that is recorded on his DD Form 214.  He also served his entire period using the day and month that is recorded on his DD Form 214; however, a typographical error occurred during preparation of his DD Form 214 which resulted in the birth year being recorded as "69" instead of "49."

2.  For historical purposes, the Army has an interest in maintaining the integrity of its records.  The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created.  In the absence of a showing of material error or injustice, there is a reluctance to recommend that those records be changed.  While it is understandable the applicant desires to now change his SSN and DOB in his military records, there is not a sufficiently compelling reason for compromising the integrity of the Army's records at this late date.  Accordingly, there is no basis for granting the applicant's requested relief.

3.  The applicant is advised that a copy of this decisional document will be filed in his military records.  This should serve to clarify any questions or confusion regarding the difference in the SSN and DOB recorded in his military records and to satisfy his desire to have the SSN shown on his social security card and the DOB shown on his birth certificate documented in his records.

4.  The evidence shows the applicant's records contain an administrative error which does not require action by the Board.  Therefore, administrative correction of the applicant's records will be accomplished by the Army Review Boards Agency (ARBA) Case Management Division (CMD) as outlined by the Board in paragraph 2 of the Board Determination/Recommendation section below.

BOARD DETERMINATION/RECOMMENDATION:

1.  The evidence presented does not demonstrate the existence of a probable error or injustice.  Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

2.  The Board determined that an administrative error in the records of the individual concerned should be corrected.  Therefore, the Board requests that ARBA CMD administratively correct his DD Form 214 to show his year of birth as "49" instead of "69."
