THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he served 7 months and 6 days of foreign service in Southwest Asia (SWA) and to add the Meritorious Unit Commendation (MUC).  

2.  The applicant states the DD Form 214 in question only shows 2 months and 14 days foreign service completed during deployment in support of Desert Storm.  His unit was awarded the MUC as cited in General Orders (GO) Number 12, dated 13 May 1994, on pages 16 through 19.
   
3.  The applicant provides:

* Defense and Finance and Accounting Service (DFAS) Letter, dated 4 June 2013, with 21 attached Leave and Earning Statements (LESs)
* GO Number 12 

CONSIDERATION OF EVIDENCE:

1.  At the time of his application, the applicant was serving on active duty in the rank of sergeant first class as a member of the Florida Army National Guard, serving in support of Operation Enduring Freedom.

2.  During the period in question, he enlisted in the Regular Army on 4 April 1989 and served until he was honorably released from active duty on 3 April 1993.  The DD Form 214 issued at that time shows:

* Item 8a (Last Duty and Major Command) – Company D, 426th Signal Battalion 
* Item 12c (Net Active Service This Period) "0004 00 00"
* Item 12f (Foreign Service) – "00 02 14"
* Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) –

* Army Commendation Medal
* Army Good Conduct Medal
* National Defense Service Medal
* Southwest Asia Service Medal with 2 bronze service stars
* Kuwait Liberation Medal (KLM) – Saudi Arabia
* Army Service Ribbon
* Army Lapel Button
* Parachutist Badge
* Drivers Badge with W Bar
* Mechanic Badge
* Expert Marksmanship Qualification Badge with Rifle Bar (M-16)

* Item 18 – "SERVICE IN SWA:  910117 – 910330"

3.  The applicant provides a copy of GO Number 12, dated 13 May 1994.  It shows the 426th Signal Battalion earned the MUC during the period 12 October 1990 – 20 March 1991.

4.  The Gulf War Deployment Roster shows his dates of foreign service as 
1 September 1990 through 8 April 1991 that equates to 7 months and 8 days foreign service.

5.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents which are prepared for individuals upon retirement, discharge, or release from active military service or control of the Army.  It also establishes standardized policy for preparing and distributing the DD Form 214.  It states for:

	a.  Item 12f, enter the total amount of foreign service completed during the period covered by the DD Form 214;

	b.  item 13, enter awards and decorations for all periods of service in the priority sequence specified in Army Regulation 600-8-22 (Military Awards); and
	c.  item 18, for an active duty Soldier deployed with his or her unit during their continuous period of active service covered by the DD Form 214, enter the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)."

6.  Army Regulation 600-8-22 prescribes Army policy and criteria concerning individual military awards.  Paragraph 9-15 contains guidance on award of the KLM-Kuwait.  It states it is authorized to members who served in support of Operations Desert Shield/Desert Storm between 2 August 1990 and 31 August 1993.

DISCUSSION AND CONCLUSIONS:

1.  The evidence of record confirms the applicant completed 7 months and 8 days service in SWA from 1 September 1990 through 8 April 1991, as evidenced by information contained on the Gulf War Roster.  Therefore items 12f and 18 of his DD Form 214 should be corrected accordingly.

2.  The evidence of record confirms the applicant's unit earned the MUC during his deployment to SWA.  Further, based on this deployment he also earned the KLM-Kuwait.  Therefore, the MUC and KLM-Kuwait should also be added to his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

     a.  amending the following entries on the DD Form 214 for the period ending 
3 April 1993 by:

* item 12f – deleting the current entry and replacing it with the entry
   "00 07 08;
* item 13 – adding the MUC and KLM – Kuwait;
* item 18 – deleting the entry "SERVICE IN SWA:  910117 – 910330" and replacing it with the entry "SERVICE IN SWA:  900901 – 910408"; and

     b.  issuing him a correction to his separation document to reflect these changes.
