		IN THE CASE OF:

		BOARD DATE: 5 February 2014

		DOCKET NUMBER: AR20130009745

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as "xxx-x4-xxxx" instead of "xxx-x0-xxxx."

2. The applicant states:

* the SSN listed on his DD Form 214 is incorrect
* it was a clerical error
* the numbers were transcribed incorrectly

3. The applicant provides his DD Form 214 and a printout from the Social Security Administration.

CONSIDERATION OF EVIDENCE:

1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2. The applicant's DD Form 4 (Enlistment Contract – Armed Forces of the United States), dated 5 December 1967, shows he recorded his SSN as "xxx-x4-xxxx."

3. He enlisted in the Regular Army on 5 December 1967 for a period of 3 years. He served as a water supply specialist in Vietnam and he was released from active duty on 4 December 1970.

4. Item 3 (SSN) of his DD Form 214 shows his SSN as "xxx-x0-xxxx."

5. He provides a letter from the Social Security Administration in Waycross, Georgia which shows his SSN as "xxx-x4-xxxx."

DISCUSSION AND CONCLUSIONS:

The applicant's DD Form 4, dated 5 December 1967, shows he recorded his SSN as "xxx-x4-xxxx." Therefore, it would be appropriate to correct his DD Form 214 accordingly.

BOARD VOTE:

____X___ ____X___ ___X__ _ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

________ ________ ________ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the current SSN entry from his DD Form 214 and replacing it with the SSN shown on his enlistment contract.

While it is understandable the applicant desires to have his military records changed to reflect the SSN shown on the Social Security card he provided, there is not a sufficiently compelling reason for compromising the integrity of the Army’s records at this late date. The applicant is advised that a copy of this decisional document will be filed in his Army Military Human Resource Record, formerly known as Official Military Personnel File. Army Regulation 635-5 (Separation Documents), effective 1 February 1967, states the SSN in item 3 of the DD Form 214 will be transcribed from the Soldier's DA Form 2139. Therefore, there is sufficient evidence to correct his DD Form 214 to show his SSN as shown on these documents. _______ _ X ______ ___ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.

His records contain a U.S. Army Administration Center (USAAC) Form 170 (Army Reserve Personnel Data Review), dated 1 March 1967, that shows he attempted to have his military records corrected to show his correct SSN. However, the evidence of record shows the SSN of "XXX-X5-XXXX" was used when the FSM enlisted in the RA in 1962 and when he was released from active duty in 1965. __________X_____________ CHAIRPERSON I certify that herein is recorded the true and complete record of the...

Item 3 (SSN) of the DD Form 214 that he was issued at the time shows his SSN as XXX-X6-XXXX. However, at the time he was being processed for induction, he indicated that his SSN was XXX-X4-XXXX and this SSN is recorded in his military records. The available evidence shows the applicant's correct SSN was entered in his military records during the period of his active duty.

The applicant requests correction of his DD Form 214 (Report of Separation from Active Duty) to show his social security number (SSN) as "XXX-X8-XXXX" instead of "XXX-X4-XXXX." On 16 September 1972 prior to his enlistment in the Regular Army, the applicant completed a DD Form 398 (Statement of Personal History) wherein he listed his SSN as "XXX-X8-XXXX." Therefore, it would be appropriate to grant relief by correcting his DD Form 214 to show his correct SSN.

The applicant states documents from the Social Security Administration (SSA) show his correct SSN is "XXX-X1-XXXX," which supports the fact that an error was made when the Military Entrance Processing Station verified his SSN upon his initial entry into the active Army in 1983. He then stated the applicant's correct SSN was "XXX-X4-XXXX" instead of what the applicant had stated. Concerning his request that his military records be corrected in DEERS, DFAS, and other appropriate agencies,...

The applicant requests correction of his DD Forms 214 (Certificate of Release or Discharge from Active Duty) for the periods ending 14 May 2005 and 20 January 2010 to show his social security number (SSN) as "XXX-X4-XXXX" instead of "XXX-X5-XXXX." A thorough review of documents contained in the applicant's military personnel records shows his social security number appears as both "XXX-X4-XXXX" and "XXX-X5-XXXX" on several documents throughout his tenure of service. Therefore, he is...
