THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his request for correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) for the period ending 22 January 1972 to show award of the Combat Infantryman Badge (CIB).

2.  He states his orders for award of the CIB were lost.  After 43 years, he was able to find someone with a copy of the original orders.

3.  He provides Headquarters, Americal Division, Special Orders Number 182, dated 1 July 1970.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20060014401 on 17 May 2007.

2.  He provided a copy of Headquarters, Americal Division, Special Orders Number 182, dated 1 July 1970, that were not previously reviewed by the ABCMR.  Therefore, these orders are new evidence that warrant consideration by the Board.

3.  The applicant enlisted in the Regular Army on 28 August 1969.  He was trained in, awarded, and served in military occupational specialty 11B (Light Weapons Infantryman).  He was honorably discharged on 27 April 1970 for immediate reenlistment which was accomplished the following day.

4.  Headquarters, Americal Division, Special Orders Number 182, dated 1 July 1970, awarded the applicant the CIB effective 1 July 1970.

5.  On 22 January 1972, he was discharged under honorable conditions and credited with 2 years, 4 months, and 22 days of active duty service.  His DD Forms 214 for the periods ending 27 April 1970 and 22 January 1972 and his DD Form 215 (Correction to DD Form 214) for the period ending 22 January 1972 do not show award of the CIB.

DISCUSSION AND CONCLUSIONS:

Headquarters, Americal Division, Special Orders Number 182, dated 1 July 1970, awarded the applicant the CIB.  Therefore, his DD Form 214 should be corrected to show this badge.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant amendment of the ABCMR's decision in Docket Number AR20060014401, dated 17 May 2007.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding award of the CIB to his DD Form 214 for the period ending 22 January 1972.
