THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his foreign service, the Southwest Asia Service Medal, and all the other awards to which he is entitled.

2.  The applicant states his DD Form 214 does not show his foreign service and all his awards.

3.  The applicant provides copies of:

* his DD Form 214
* Permanent Orders 308-2, Headquarters, Fort Stewart and Hunter Army Airfield, dated 4 November 2009
* 1st Heavy Brigade Combat Team, memorandum:  Subject:  Policy Letter on Reintegration Guidance and Procedures, dated 18 June 2010
* Veterans Service Office, Otter Tail County, Fergus Falls, Minnesota, letter, dated 17 April 2013

CONSIDERATION OF EVIDENCE:

1.  Following prior service in the Minnesota Army National Guard, the applicant enlisted in the Regular Army on 7 February 2008.  He held military occupational specialty 92Y (Unit Supply Specialist).


2.  He was honorably released from active duty on 17 April 2011.  His DD Form 214 shows in:

	a.  item 12f (Foreign Service):  "0000 00 00" (indicating no foreign service);

	b.  item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized):

* Army Commendation Medal
* Army Good Conduct Medal
* National Defense Service Medal
* Iraq Campaign Medal with campaign star
* Army Service Ribbon

	c.  item 18 (Remarks):  No deployment entry

3.  An email from the Defense Finance and Accounting Service, dated 21 May 2013, confirmed he received hazardous fire pay (HFP)/imminent danger pay (IDP) for service in Kuwait from 16 December 2009 through 11 December 2010 (11 months and 26 days).

4.  Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards.  The regulation states the:

   a.  Southwest Asia Service Medal is awarded to members of the Armed Forces of the United States serving in Southwest Asia and contiguous waters or airspace there over, on or after 2 August 1990 to 30 November 1995.  

	b.  Overseas Service Ribbon is awarded to all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status for successful completion of overseas tours.  According to the Awards Branch at U.S. Army Human Resources Command, Iraq and Afghanistan are considered isolated areas where tour lengths have not been established by the Department of Defense.  Soldiers who serve 11 cumulative months in a 24-month period or 9 months continuous in Iraq or Afghanistan get credit for a completed short tour.  

	c.  Global War on Terrorism Service Medal is authorized for award to all Soldiers on active duty on or after 11 September 2001 to a date to be determined.

	
	d.  A bronze service star is authorized for wear with the Iraq Campaign Medal for participation in each credited campaign.  Approved campaigns include

* Iraqi Sovereignty (1 January 2009-31 August 2010)
* New Dawn (1 September 2010-31 December 2011)

5.  Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214.  It is important that information entered on the form should be complete and accurate. 
The DD Form 214 is a summary of a Soldier's most recent period of continuous active duty to include attendance at basic and advanced individual training.  Item 12f shows the total amount of foreign service completed during the period and for an active duty Soldier, item 18 shows the entry "SERVICE IN (Name of Country Deployed) FROM (inclusive dates for example YYYYMMDD-YYYYMMDD)

DISCUSSION AND CONCLUSIONS:

1.  He served in Kuwait/Iraq from 16 December 2009 through 11 December 2010.  Therefore, he served a qualifying period of service for award of the Overseas Service Ribbon.   

2.  The applicant served on active duty from 7 February 2008 to 17 April 2011.  Therefore, he served a qualifying period of service for award of the Global War on Terrorism Service Medal.

3.  He also participated in two campaigns during his service in Iraq.  Therefore, he is entitled to two bronze service stars for wear on his already-awarded Iraq Campaign Medal.

4.  Although DFAS' confirmation indicates he was deployed only to Kuwait, his record shows he also served in Iraq.  Therefore, his DD Form 214 should be corrected to show his foreign service as Kuwait/Iraq from 16 December 2009 through 11 December 2010.  Therefore, his DD Form 214 should be corrected accordingly.

5.  He did not serve a qualifying period of service for award of the Southwest Asia Service Medal.  His record should not be corrected to show the Southwest Asia Service Medal as an authorized award.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  deleting the current entry in item 12f of his DD Form 214 and replacing it with "0000 11 26";

	b.  deleting the Iraq Campaign Medal with Campaign Star:

	c.  adding the following awards to item 13 of his DD Form 214:

* Global War on Terrorism Service Medal
* Overseas Service Ribbon 
* Iraq Campaign Medal with two bronze service stars

	d.  adding the entry "SERVICE IN KUWAIT/IRAQ FROM 20091216-20101211" to item 18 of his DD Form 214.

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to showing he is authorized the Southwest Asia Service Medal.
