		IN THE CASE OF:

		BOARD DATE: 17 December 2013

		DOCKET NUMBER: AR20130007561

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his 1973 DD Form 214 (Report of Transfer or Discharge) to show his rank as first sergeant (1SG).

2. The applicant states his U.S. Army Reserve (USAR) rank of 1SG was never added to his DD Form 214.

3. The applicant provides copies of his DD Form 214 and orders, dated
21 March 1973.

CONSIDERATION OF EVIDENCE:

1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2. The applicant's DD Form 214 shows he had 8 years and 27 days of prior service when he enlisted in the Regular Army on 24 January 1967.
3. He served for 6 years and was discharged as a staff sergeant (pay grade E-6) on 23 January 1973. His DD Form 214 shows his rank as staff sergeant. He enlisted in the USAR the next day. He was promoted to sergeant first class (pay grade E-7) in July 1972 and to 1SG (pay grade E-8) in October 1975.

4. Headquarters, Fifth U.S. Army, Orders 55-146, dated 21 March 1977 show the applicant, then a USAR 1SG, was discharged to reenlist for his own vacancy.

5. Army Regulation 635-5 prescribes the separation documents prepared for Soldiers separation from the Army. It states the DD Form 214 is a synopsis of the Soldier’s most recent period of continuous active duty and provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge.

DISCUSSION AND CONCLUSIONS:

Each DD Form 214 is a summary of a specific period of active service. It is not intended to reflect changes that occur after that period of active service. His 1973 DD Form 214 correctly shows his rank as staff sergeant.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

____X____ ____X____ ____X____ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

On 4 December 1973, Headquarters, MOARNG, Office of the Adjutant General, published Special Orders Number 144 promoting him to SGM/E-9 under the authority of paragraph 3a of National Guard Regulation (NGR) 624-200 (Appointment and Reductions of Enlisted Personnel) effective 8 December 1973. The policy for grade determination for computation of retired pay required an enlisted member to serve in the higher grade for at least 185 days to qualify for retirement in that grade. However, 11 days...

The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show his rank as a first sergeant (1SG) instead of a master sergeant (MSG). Chapter 12 of that regulation provides that noncommissioned officers holding the grade of MSG at retirement, whose records show successful service as a 1SG, will be placed on the Retired List in the tile grade “First Sergeant.” The only criteria for such placement on the retired list is that the Soldier...

The evidence of record shows the applicant was promoted to MSG/E-8 on 30 April 1992. Although he appears to have satisfactorily served as a 1SG and he was transferred to the Retired Reserve in that rank, regulations require the presentation of valid appointment orders to 1SG to be placed on the Retired List in that rank. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by correcting Orders P10-590489 to show he was placed on...

The applicant requests his orders transferring him to the Retired Reserve be corrected to show him as a first sergeant (1SG) instead of a master sergeant (MSG). On 9 January 1987, he was released from active duty and transferred to the U.S. Army Reserve (USAR) where he remained until his retirement. Therefore, the grade MSG on his orders, dated 22 March 2005, for transfer to the Retired Reserve on 21 April 2005 is correct.

There are no records to show the applicant's personnel service record was reviewed and a determination made by the Army Grade Determination Board. Based on the evidence of record, the highest grade the applicant satisfactorily held was that of 1SG/E-8 in the USAR from May 1987 through June 1997, a period of more than 10 years. The applicant's retired pay grade is currently E-7, but should be E-8 and his appropriate grade or rank should be as a 1SG based on his documented service as a 1SG.

The applicant's service record does not show he held the special qualification identifier (SQI) "M" for 1SG, or that he completed the first sergeant course (FSC). The evidence does not support the applicant's request for correction of retirement orders to show he retired as a 1SG. There is no evidence that he completed the FSC or that he was awarded SQI "M." 3.

The applicant's military records show that he was promoted to the rank of MSG/pay grade E-8 with an effective date of 1 November 1985 and a date of rank of 31 October 1985. While it is clear that the applicant successfully served as a 1SG during his military career, he was laterally appointed from 1SG to MSG prior to his retirement. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he retired in the rank of first sergeant (1SG). The applicant was serving in the rank of MSG when his DD Form 214 was prepared and he was placed on the Retired List the following day in the rank of 1SG. Accordingly, his DD Form 214 is properly prepared and there appears to be no basis to grant his request to change his DD Form 214 to reflect the rank of 1SG.
