THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show award of the Air Medal with "V" Device and Republic of Vietnam Gallantry Cross with Bronze Star.

2.  The applicant states he was awarded the aforementioned medals, but they were not listed on his DD Form 214.

3.  The applicant provides:

* General Order Number 26, dated 19 September 1970
* General Orders Number 6501, dated 5 November 1970
* Air Medal with "V" Device Certificate, dated 5 November 1970
* authorization for individual Republic of Vietnam Gallantry Cross with Bronze Star, dated 24 May 1971
* DD Form 214

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  Having prior enlisted service, the applicant was appointed as a second lieutenant in the U.S. Army Reserve (USAR) on 20 December 1968 with concurrent call to active duty.  He completed training and was awarded specialty 9300 (Military Intelligence Officer).

3.  He served in Vietnam from 28 June 1969 through 6 December 1970, during four campaigns, and was assigned to the following units from:

* 1 July 1969 to 4 August 1970 – U.S. Military Assistance Command-Vietnam (MACV)
* 5 August to 5 December 1970 – Civil Operations and Rural Development Support, IV Corps and Military Region 4

4.  General Orders Number 6501 issued by Headquarters, MACV, dated 5 November 1970, awarded him the Air Medal with "V" Device for heroism while participating in aerial flight in Vietnam on 9 December 1969.

5.  He was honorably released from active duty on 7 December 1970.  His DD Form 214 shows he was awarded or authorized the:

* National Defense Service Medal
* Purple Heart
* Bronze Star Medal
* Vietnam Service Medal
* two overseas service bars
* Republic of Vietnam Campaign Medal

6.  He provides a memorandum from Headquarters, MACV, dated 24 May 1971, authorizing him award of the Republic of Vietnam Gallantry Cross with Bronze Star.

7.  Army Regulation 600-8-22 (Military Awards) contains the regulatory guidance for award of the Vietnam Service Medal.  A bronze service star is authorized with this award for each Vietnam campaign a member is credited with participating in.

8.  Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the awards received by units serving in 
Vietnam.  This pamphlet shows MACV was cited for award of the Meritorious Unit Commendation for the period 1 November 1968 through 30 June 1970 in Department of the Army General Orders Number 51, dated 1971.

9.  Department of the Army General Orders Number 8, dated 1974, authorized award of the Republic of Vietnam Gallantry Cross with Palm Unit Citation to all personnel assigned to Headquarters, MACV, and its subordinate units during the period 8 February 1962 to 28 March 1973 and to Headquarters, U.S. Army Vietnam, and its subordinate units during the period 20 July 1965 to 28 March 1973.

DISCUSSION AND CONCLUSIONS:

1.  General orders awarded the applicant the Air Medal with "V" Device for heroism while participating in aerial flight in Vietnam on 9 December 1969.  Therefore, his DD Form 214 should be corrected to show this award.

2.  The evidence of record shows he was awarded the Republic of Vietnam Gallantry Cross with Bronze Star.  Therefore, his DD Form 214 should be corrected to show this award.

3.  General orders also awarded MACV the Meritorious Unit Commendation and Republic of Vietnam Gallantry Cross with Palm Unit Citation.  Therefore, he is entitled to correction of his DD Form 214 to show these unit awards.

4.  He participated in four campaigns during his period of service in Vietnam.  Therefore, he is entitled to four bronze service stars for wear on his already-awarded Vietnam Service Medal and correction of his DD Form 214 to show these service stars.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

* deleting the Vietnam Service Medal from his DD Form 214
* adding the following awards to his DD Form 214 –

* Air Medal with "V" Device
* Vietnam Service Medal with four bronze service stars
* Republic of Vietnam Gallantry Cross with Bronze Star
* Meritorious Unit Commendation
* Republic of Vietnam Gallantry Cross with Palm Unit Citation
