THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Korea Defense Service Medal and a fourth Overseas Service Ribbon.

2.  The applicant states he served in Korea from 25 April 1996 to 25 April 1997 and should have received due awards.

3.  The applicant provides:

* DA Form 2-1 (Personnel Qualification Record – Part II)
* DD Form 214 for the period ending 31 May 1998
* DD Form 214 for the period ending 4 December 1974
* multiple DA Forms 2166-7 (Noncommissioned Officer Evaluation Report)

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 13 December 1971.  He served in Germany from 20 April 1972 to 5 December 1974 and he was credited with completion of an overseas tour.

2.  He was honorably released from active duty on 4 December 1974.  His DD Form 214 for this period of service shows he was awarded or authorized the National Defense Service Medal and Army Good Conduct Medal.

3.  He again enlisted in the Regular Army on 9 February 1982.  He served through multiple reenlistments or extensions and he attained the rank/grade of sergeant first class (SFC)/E-7.  He performed the following periods of foreign service as indicated:

* Germany from 3 August 1988 to 9 August 1990 – he was credited with completion of an overseas tour
* Southwest Asia from 19 October 1990 to 19 April 1991 in a temporary duty status (TDY) – he was not credited with completion of an overseas tour
* Korea from 25 April 1996 to 25 April 1997 – he was credited with completion of an overseas tour

4.  He retired on 31 May 1998 and he was placed on the Retired List in the rank/grade of SFC/E-7 on 1 June 1998.  His DD Form 214, as amended by a DD Form 215 (Correction to DD Form 214), dated 18 October 2012, shows he was awarded or authorized the:

* Meritorious Service Medal (2nd Award)
* Army Commendation Medal (4th Award)
* Army Achievement Medal
* Meritorious Unit Commendation
* Army Good Conduct Medal (5th Award)
* National Defense Service Medal (2nd Award)
* Southwest Asia Service Medal with three bronze service stars
* Noncommissioned Officer Professional Development Ribbon with Numeral 2
* Army Service Ribbon
* Overseas Service Ribbon (3rd Award)
* Kuwait Liberation Medal (Kuwait)
* Kuwait Liberation Medal (Saudi Arabia)
* Expert Field Medical Badge

5.  Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards.

	a.  The Korea Defense Service Medal is authorized for award to members of the Armed Forces of the United States who served on active duty in support of the defense of the Republic of Korea.  The area of eligibility encompasses all land area of the Republic of Korea and the contiguous water out to 12 nautical miles and all air spaces above the land and water area.  The period of eligibility is 28 July 1954 to a date to be determined by the Secretary of Defense.

	b.  The Overseas Service Ribbon was established by the Secretary of the Army on 10 April 1981.  It is awarded to all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status upon successful completion of overseas tours.

DISCUSSION AND CONCLUSIONS:

1.  The applicant served in Korea from 25 April 1996 to 25 April 1997 during a qualifying period of service for eligibility for the Korea Defense Service Medal.  Therefore, his DD Form 214 should be corrected to show this award.

2.  The applicant received overseas tour credit for three tours (once for Korea and twice for Germany), not four as he believes.  His service in Southwest Asia was a deployment in a TDY status, not a permanent change of station.  Therefore, he only qualifies for three awards of the Overseas Service Ribbon.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding award of the Korea Defense Service Medal to his DD Form 214 for the period ending 31 May 1998.

2.  The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so 

much of the application that pertains to a fourth award of the Overseas Service Ribbon.
