THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to:

* remove the Armed Forces Reserve Medal with "M" Device
* add the Army Commendation Medal and Army Achievement Medal

2.  The applicant states the Armed Forces Reserve Medal with "M" device is authorized to Soldiers who have served for 10 years; he joined the Army in 2008 and did not qualify for this medal.  He believes the intended award is the Army Reserve Components Achievement Medal.  He also states he was awarded the Army Commendation Medal and the Army Achievement Medal. 

3.  The applicant provides:

* DD Form 214
* Extract of Army Regulation 600-8-22 (Military Awards)
* DA Form 638 (Recommendation for Award) and certificate, award of the Army Commendation Medal
* DA Form 638 and certificate, award of the Army Achievement Medal

CONSIDERATION OF EVIDENCE:

1.  The applicant was appointed as a Reserve commissioned officer and executed an oath of office on 10 April 2008.  He completed the Transportation Basic Officer Leader Course. 
2.  He was ordered to active duty on 31 July 2010 and subsequently served in Kuwait with the 1188th Deployment and Distribution Support Battalion from 1 September 2010 to 24 July 2011.  He was honorably released from active duty on 17 August 2011.  His DD Form 214 shows the:

* Meritorious Unit Commendation
* National Defense Service Medal
* Global War on Terrorism Service Medal
* Global War on Terrorism Expeditionary Medal
* Army Service Ribbon
* Overseas Service Ribbon
* Armed Forces Reserve Medal with "M" Device

3.  He provides:

	a.  DA Form 638 and certificate, dated 27 June 2011, awarding him the Army Commendation Medal for service as the 1188th Deployment and Distribution Support Center Contracting Officer Representative from 31 July 2010 to 15 July 2011, by authority of Permanent Orders Number 174-010, issued by Headquarters, 595th Transportation Brigade. 

	b.  DA Form 638 and certificate, dated 10 July 2011, awarding him the Army Achievement Medal for achievement while appointed as the Army Physical Fitness Test Officer in Charge from 31 July 2010 to 15 July 2011, by authority of Permanent Order 192-40, issued by Headquarters, 1188th Deployment and Distribution Support Battalion. 

4.  Army Regulation 600-8-22 (Military Awards) states:

	a.  The Armed Forces Reserve Medal is awarded for honorable and satisfactory service as a member of one or more of the Reserve Components for a period of 10 years.  Also qualifying for this award are members who on or after 1 August 1990 were called to active duty and served under Sections 12301(a), 12302, 12304, 12406, Title 10, U.S. Code, or, in the case of the U.S. Coast Guard Reserve, Section 712 of Title 14, U.S. Code.  The member must have been called or volunteered and served on active duty in support of specific U.S. military operations or contingencies designated by the Secretary of Defense, as defined in Section 101(A) (13) of Title 10, U.S. Code. 

	b.  The "M" Device is worn on the Armed Forces Reserve Medal to denote service by Reserve Component personnel who volunteered or were called to active duty during a mobilization or a contingency designated by the Secretary of Defense.
	c.  The Ten-Year Device (hourglass with Roman numeral "X") is authorized for wear on the Armed Forces Reserve Medal to denote each 10-year period of Reserve Component service.  The first 10-year period is denoted by a bronze hourglass, the second 10-year period by a silver hourglass, and the third by a gold hourglass.  Forty years of Reserve Component service is recognized by a gold hourglass followed by a bronze hourglass. 

5.  Army Regulation 600-8-19 states:

	a.  The Army Commendation Medal may be awarded to any member of the Armed Forces of the United States who, while serving in any capacity with the Army after 6 December 1941, distinguishes himself or herself by heroism, meritorious achievement, or meritorious service.  As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required.

	b.  The Army Achievement Medal is awarded to members of the Armed Forces of the United States, who while serving in a noncombat area on or after 1 August 1981, distinguished themselves by meritorious service or achievement. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required.

	c.  Only one decoration will be awarded to an individual or unit for the same act, achievement, or period of meritorious service.  The award of a decoration in recognition of a single act of heroism or meritorious achievement does not preclude an award for meritorious service at the termination of an assignment. Recommendations for award of a decoration for meritorious service will not refer to acts of heroism or meritorious achievements which have been previously recognized by award of a decoration

DISCUSSION AND CONCLUSIONS:

1.  With respect to the Armed Forces Reserve Medal with "M" Device, contrary to the applicant's belief, this award is in fact authorized to members of the Reserve Component who have been called or volunteered and served on active duty in support of specific U.S. military operations or contingencies designated by the Secretary of Defense, under Sections 12301(a), 12302, 12304, 12406, Title 10, U.S. Code.  The applicant's deployment to Kuwait falls into this category.  

2.  With respect to the other two awards:

	a.  He was awarded the Army Commendation Medal for service from 31 July 2010 to 15 July 2011, by authority of Permanent Orders Number 174-010, issued by Headquarters, 595th Transportation Brigade.   He was also issued the Army Achievement Medal for achievement from 31 July 2010 to 15 July 2011, by authority of Permanent Order 192-40, issued by Headquarters, 1188th Deployment and Distribution Support Battalion. 

	b.  Although the period covered on both awards is exactly the same, one award states "service" while the other states "achievement" and the reason for the each award is not the same.  

	c.  In view of the foregoing evidence, the applicant is entitled to the listing of both awards on his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to his DD Form 214 the Army Commendation Medal and the Army Achievement Medal. 

2.  The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to removing from his DD Form 214 the Armed Forces Reserve Medal with "M."
