THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant, on behalf of her deceased father (a former service member (FSM)), requests correction of the FSM's date of entry (DOE), date of rank (DOR), and date of discharge listed on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). 

2.  The applicant states the incorrect dates were brought to her attention upon the death of her father while purchasing a Department of Veterans Affairs monument.

3.  The applicant provides:

* DD Form 214
* Standard Form 180 (Request Pertaining to Military Records)
* Obituary
* Certificate of Death
* Page 3 of a Court Order

CONSIDERATION OF EVIDENCE:

1.  The FSM's record shows he enlisted in the Regular Army for a period of 3 years on 22 September 1960.  

2.  The FSM's record contains a DA Form 24 (Service Record) which shows he had 254 days of time lost due to confinement for the period 23 May 1962 to      31 January 1963.
3.  The FSM's DA Form 24 also shows he was promoted to the permanent rank/grade of private first class (PFC)/E-3 on 6 April 1963, by Order Number 7, issued by Company B, Special Troops, Fort Polk, LA, dated 6 April 1963.

4.  On 1 June 1964, he was relieved from active duty and transferred to the U.S. Army Reserve Control Group (Reinforcement) for completion of his Reserve obligation.

5.  The DD Form 214 he was issued at the time shows in:

* Item 3a (Grade, Rate or Rank) "PFC E-3 (P)"

* Item 3b (DOR) "6 Apr 63"

* Item 19c (DOE) "22 Sep 1966"

* Item 24 (Statement of Service) shows his total active service as 3 years

6.  Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214.  The regulation directs the purpose of the separation document is to provide the individual with documentary evidence of their military service.  It is important that information entered on the form should be complete and accurate.  

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that the FSM's DD Form 214 should be corrected to show his correct DOE, DOR, and date of discharge.

2.  The evidence of record shows the FSM enlisted in the Regular Army for a period of 3 years on 22 September 1960.  It appears his DD Form 214 contains a typographical error which incorrectly shows the year of his DOE as 1966 instead of 1960.  Therefore, he is entitled to correction of his DD Form 214 to show his DOE as 22 September 1960. 

3.  Evidence contained in the FSM's records also show he was promoted to the permanent rank/grade of PFC/E-3 on 6 April 1963; therefore, there is no basis for correcting his DD Form 214 in reference to his DOR.  

4.  As a result of the correction to the FSM's DOE, evidence shows the FSM  entered service on 22 September 1960 and was relieved from active duty on      1 June 1964 (a total period of 3 years, 8 months, and 11 days).  He was confined for 254 days (a period of 8 months and 11 days) which is considered lost time.  By subtracting his lost time from his total period of service it is determined he completed 3 years of creditable service.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the entry "22 Sep 66" from Item 19c of his DD Form 214 and adding the entry "22 Sep 60."

2.  The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to correcting the FSM's DOR and date of discharge.
