THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his earlier request for correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his entry date as 18 July 1968 vice 18 July 1969.

2.  The applicant states, in effect, he originally requested his entry date corrected to show 17 July vice 18 July.  However, his intent was to correct the year of entry as 1968 vice 1969. 

3.  The applicant provides:

* DD Form 214
* DD Form 4 (Enlistment Contract - Armed Forces of the United States)
* DA Form 20 (Enlisted Qualification Record)

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20080019946, on 9 June 2009.

2.  The applicant provides a new argument clarifying his request.  This new argument warrants consideration by the Board.

3.  The applicant's record shows he enlisted on 18 July 1968.  His DD Form 4 shows he entered his initial enlistment in the Regular Army on 18 July 1968 for a period of 3 years.  This form also shows he took an oath of enlistment on 18 July 1968.

4.  Special Orders Number 142, issued by the Armed Forces Examining and Entrance Station, Roanoke, VA, on 18 July 1968, show he enlisted under the provisions of Army Regulation 601-210 (Regular Army Enlistment Program) effective 18 July 1968 with an active duty commitment of 3 years. 

5.  He completed basic combat training and advanced individual training.  Upon completion of advanced individual training, he was awarded military occupational specialty 63B (Wheeled Vehicle Repairman).  

6.  His DA Form 20 which was created upon his entry on active duty shows he enlisted in the Regular Army on 18 July 1968 for a period of 3 years.  This form also shows he was assigned to the U.S. Army Replacement Station, Fort Bragg, NC, on 18 July 1968.

7.  He was honorably released from active duty on 21 April 1971.  He completed 2 years and 9 months of creditable active service and he had 4 days of lost time. Item 17c (Date of Entry) of his DD Form 214 shows the entry "18 Jul [July] 69 [1969]."

8.  Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  The DD Form 214 was a synopsis of the Soldier’s most recent period of continuous active duty.  It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement or discharge.  Paragraph 41 of this regulation stated that the date the Soldier entered on active duty would be entered in item 17c of the DD Form 214.

DISCUSSION AND CONCLUSIONS:

The applicant enlisted in the Regular Army and entered active duty on 18 July 1968.  He was honorably released from active duty on 21 April 1971.  He completed 2 years and 9 months of active service.  It appears when his DD Form 214 was processed, it inadvertently listed his year of entry as 1969 vice 1968.  Therefore, he is entitled to correction of his DD Form 214 to show the date of entry as 18 July 1968.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20080019946, dated 9 June 2009.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting from item 17c the entry "18 Jul 69" and adding the entry "18 July 68."
