THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of an earlier request to add the Valorous Unit Award to his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge).  

2.  The applicant states the previous decision stated he was assigned to Company E, 4th Battalion, 39th Infantry Regiment, 9th Infantry Division from 
28 October 1967 to 20 February 1968.  He was in fact assigned to Company B not Company E.

3.  The applicant provides:

* DA Form 1 (Morning Report), dated 28 December 1967
* orders awarding him the Combat Infantryman Badge
* orders awarding him the Purple Heart
* an undated letter from Command Sergeant Major (CSM) G_______

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20120003939 on 4 September 2012.

2.  The DA Form 1 he submitted is new evidence which requires consideration by the ABCMR.
3.  On 22 May 1967, he was inducted into the Army of the United States.  He completed basic combat and advanced individual training and was awarded military occupational specialty 11B (Light Weapons Infantryman).

4.  His DA Form 20 (Enlisted Qualification Record) shows that on 28 October 1967, he was assigned to Company E, 4th Battalion, 39th Infantry, 9th Infantry Division, as a rifleman.

5.  The DA Form 1 submitted by the applicant is a morning report for Company B, 4th Battalion, 39th Infantry, and shows the applicant was attached to that unit on 28 December 1967.

6.  Headquarters, 9th Infantry Division, Special Orders Number 15, dated 
15 January 1968, awarded the applicant the Combat Infantryman Badge.  These orders identify him as being assigned to Company B, 4th Battalion, 39th Infantry.

7.  Headquarters, 93rd Evacuation Hospital General Orders Number 45, dated 
15 February 1968, awarded the applicant the Purple Heart.  These orders identify him as being assigned to Company B, 4th Battalion, 39th Infantry.  

8.  On 21 May 1969, he was released from active duty.  

9.  Department of the Army General Order Number 5, dated 27 January 1969, awarded the Valorous Unit Award to the 2nd Battalion (Mechanized), 
47th Infantry, and its attached unit, Company B, 4th Battalion, 39th Infantry, for extraordinary heroism while engaged in military operations on 31 January 1968.

DISCUSSION AND CONCLUSIONS:

1.  While his DA Form 20 shows he was initially assigned to Company E, the morning report for Company B shows he was attached to that company on 
28 December 1967.  Subsequent orders awarding him the Combat Infantryman Badge and the Purple Heart show that he continued to be assigned and/or attached to Company B, 4th Battalion, 39th Infantry.

2.  There is sufficient evidence to show he was attached to Company B, 
4th Battalion, 39th Infantry, on 31 January 1968, the date of the action for which the unit was awarded the Valorous Unit Award.  Therefore, he is authorized the Valorous Unit Award and this award should be added to his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20120003939, dated 4 September 2012.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the Valorous Unit Award to his DD Form 214.
