THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his military records to show his year of birth as 1948.

2.  The applicant did not provide a reason for his request.

3.  The applicant provides a Commonwealth of Virginia, Certification of Vital Record.

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  On 13 October 1966, the applicant underwent a medical examination for the purpose of enlistment in the Regular Army.  The Report of Medical Examination shows his year of birth as 1947.
3.  He enlisted in the Regular Army (RA) on 18 October 1966.  His DD Form 
4 (Enlistment Contract) shows his year of birth as 1947.  

4.  He was released from active duty on 25 September 1969.  His DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) for this period of service shows his year of birth as 1947.  

5.  He reenlisted in the RA on 5 February 1971.  His DD Form 4 for this enlistment shows his year of birth as 1947.  

6.  He continued his service in the RA throughout a series of reenlistments until he was retired for length of service on 30 November 1988.  All of his DD Forms 4 and his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 30 November 1988 show his year of birth as 1947.

7.  There is no evidence in his military records showing he ever listed his year of birth as 1948.

8.  He provided a Commonwealth of Virginia Certification of Vital Record that shows his year of birth as 1948.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's contention that his military records should be corrected to show his year of birth as 1948 has been carefully reviewed.

2.  The evidence of record shows he entered the military and listed his year of birth as 1947 throughout his entire military career.  

3.  For historical purposes, the Army has an interest in maintaining the integrity of its records.  The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created.  In the absence of a showing of material error or injustice, this Board is reluctant to recommend these records be changed.

4.  While his desire to have the year of birth shown on his Certificate of Vital Record recorded on his military records is understandable, there is not a compelling reason for compromising the integrity of the Army's records at this late date.

5.  He is advised that a copy of this Record of Proceedings will be filed in his Army Military Human Resource Record (AMHRR).  This should serve to clarify any questions or confusion regarding the difference in the year of birth recorded in his military records and to satisfy his desire to have the year of birth he now claims is correct documented in his AMHRR.
