THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his previous request to correct his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as XXX-XX-2188 instead of XXX-XX-2227.

2.  The applicant states, in effect, the Social Security Administration (SSA) replaced his old SSN with a new SSN.

3.  The applicant provides:

* A self-authored statement
* Receipt from the SSA, dated 28 January 2006 
* Excerpt from his tax returns, dated 15 February 2011 
* Receipt from the SSA, dated 1 March 2011
* Puerto Rico Department of Treasury, Corrected Withholding Statement, dated 19 May 2011
* Teacher's pension receipts, dated 29 February and 15 March 2012 

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for 
Correction of Military Records (ABCMR) in Docket Number AR20110009650, on 22 November 2011.
2.  The applicant provides two receipts from the SSA, an excerpt from his tax returns, a corrected withholding statement, and two teacher's pension receipts, which he believes constitutes new evidence.  This new evidence was not previously considered by the Board; therefore, it warrants consideration.

3.  He was inducted into the Army on 8 April 1965 and honorably released from active duty on 13 January 1967.  He was transferred to the U.S. Army Reserve Control Group (Annual Training) to complete his remaining Reserve obligation.  Item 32 (Remarks) of his DD Form 214 shows his SSN as "XXX-XX-2227."  

4.  As stated in Docket Number AR20110009650, his discharge letter orders and an Army Reserve Personnel Data Review document were the only documents found in his military records containing an SSN.  This is because at the time of his service the Army used service numbers in lieu of the SSN.  These documents show his SSN as "XXX-XX-2227."

5.  He provided two receipts from the SSA.  The first, dated 28 January 2006, shows he applied for a social security card on 12 January 2006.  The second receipt dated, 1 March 2011, contains a name similar to his and shows the SSN as "XXX-XX-2188."

6.  He provided an excerpt from his tax returns, dated 15 February 2011.  This excerpt contains a name similar to his and shows the correct SSN as 
"XXX-XX-2188."

7.  He provided a corrected withholding statement from the Puerto Rico Department of Treasury, dated 19 May 2011.  This form contains a name similar to his and shows the correct SSN as "XXX-XX-2188" and an incorrect SSN of 
"XXX-XX-2227."

8.  He provided two teacher's pension receipts.  The first, dated 29 January 2012, contains a name similar to his and shows the SSN as "XXX-XX-2227."
The second receipt dated, 15 March 2012, contains a name similar to his and shows the SSN as "XXX-XX-2188."

9.  Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214.  The regulation directs, in pertinent part, that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service.  It is important that information entered on the form should be complete and accurate.


DISCUSSION AND CONCLUSIONS:

1.  The available evidence shows the applicant used SSN "XXX-XX-2227" throughout his military service.  He did not use SSN "XXX-XX-2188."

2.  For historical purposes, the Army has an interest in maintaining the integrity of its records.  The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created.  In the absence of a showing of material error or injustice, there is a reluctance to recommend that those records be changed.  While it is understood that the applicant desires to now record his requested SSN in his military records there is not a sufficiently compelling reason for compromising the integrity of the Army's records at this late date.

3.  Absent evidence, such as military records containing his correct SSN, there is an insufficient basis to grant him relief in this case.

The evidence presented does not demonstrate the existence of a probable error or injustice.  Therefore, the Board determined that the overall merits of this case are insufficient as a basis to amend the decision of the ABCMR set forth in Docket Number AR20110009650, dated 22 November 2011.
