THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, his Date of Rank (DOR) to the grade of Staff Sergeant (SSG) be adjusted to show he was promoted on 1 May 2012.
2. He states his Battalion S-1 failed to submit his promotion packet in a timely manner. The lack of attention to detail caused his promotion to be delayed.
3. He provides a DA Form 3355 (Promotion Point Worksheet).
CONSIDERATION OF EVIDENCE:
1. His record shows he enlisted in the U.S. Army Reserve (USAR) on 21 April 2008 in the rank of specialist/E-4. He was promoted to the rank of sergeant/E-5 on 1 November 2010 and is currently serving on active duty in the Active Guard/Reserve (AGR) program.
2. The applicant provided a DA Form 3355 which shows he appeared before the SSG Promotion Board on 21 December 2011. His name was incorporated on the Promotion Standing list with a total of 282 promotion points.
3. His records contain Headquarters (HQS), 88th Regional Support Command, Orders 12-137-00024, dated 16 May 2012 which show he was promoted to the rank of SSG/E-6 effective 1 June 2012, with a DOR of 1 June 2012.
4. In connection with the processing of this case, an advisory opinion was obtained from the U.S. Army Reserve Command (USARC), Chief, Personnel Management Division. That office recommended approval of the applicants request for promotion to the rank of SSG/E-6 with a DOR adjustment to 1 May 2012 in accordance with Army Regulation 600-8-19 (Enlisted Promotions and Reductions) since he met the cutoff score for 1 May 2012 in military occupational specialty 42A (Human Resources Specialist). A copy of the opinion was sent to the applicant for response; however, he did not submit one.
DISCUSSION AND CONCLUSIONS:
The applicant met the cutoff score for promotion to the grade of SSG/E-6 effective 1 May 2012. As such, Orders 12-137-00024, dated 16 May 2012 should be amended to read: Promotion is effective 1 May 2012, with a DOR of
1 May 2012. He should also be paid any back pay and allowances as a result.

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending HQS, 88th Regional Support Command, Orders 12-137-00024, dated 16 May 2012 to read: Promotion is effective 1 May 2012, with a DOR of 1 May 2012 and paying him all due back pay and allowances.
