THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his previous request for correction of his social security number (SSN) to read 5XX-XXX-XXX.   

2.  The applicant states, in effect, he went to the Social Security Administration (SSA) and obtained a print-out to support his request to correct his military records to reflect that he enlisted under the wrong SSN.  The SSN listed in his military records belongs to his father.  He has the same name as his father, his name has the suffix of "junior" and his father's name has a suffix of "senior."  This type of mix-up has occurred a number of times.  His information has been mixed-up with his father's.  

3.  He provides a print-out from the SSA and his denial letter from the Army Board for Correction of Military Records (ABCMR).

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the ABCMR in Docket Number AR20110014318 on 12 January 2012.

2.  The applicant submits a print-out from the SSA.  This document is new evidence that will be considered by the Board.

3.  The applicant's military records show he enlisted in the Delayed Entry Program on 16 June 1977.  He enlisted in the Regular Army (RA) on 17 August 1997, for 4 years.  He extended his enlistment on 15 Apirl 1981 for 12 months.  

4.  His record contains the following forms that list his SSN as 2XX-XX-XXXX and his social security card was used to verify this was his SSN at the time of enlistment:

* DD Form 1966/5 (Section V), dated 9 June 1977
* DD Form 4 (Enlistment or Reenlistment Agreement - Armed Forces of the United States), dated 16 June 1977
* DD Form 4c (Enlistment or Reenlistment Agreement (Continuation Sheet)), dated 17 August 1977
* DA Form 2-1 (Personnel Qualification Record - Part II), prepared on 23 January 1978
* DD Form 1965 (Oath of Extension of Enlistment), dated 15 April 1981
* DD Form 93 (Record of Emergency Data), dated 20 October 1981

5.  On 1 October 1982, he was honorably released from active duty and transferred to the U.S. Army Reserve (USAR) Control Group (Reinforcement).  Item 3 (SSN) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) lists his SSN as 2XX-XX-XXXX.

6.  He was honorably discharged from the USAR effective 15 June 1983.  His discharge orders list his SSN as 2XX-XX-XXXX.

7.  He provides a print-out from the SSA which states their records indicate SSN 5XX-XX-XXXX was assigned to an individual with the same name as the applicant.  This print-out does not verify whether the name of the individual listed contains the suffix of "junior" or "senior."  

DISCUSSION AND CONCLUSIONS:

1.  The available evidence indicates the applicant enlisted and served using SSN 2XX-XX-XXXX throughout his service in the RA and USAR. 

2.  Although he provided a print-out from the SSA verifying an individual with the same name that he uses was assigned SSN 5XX-XX-XXXX there is no evidence available to indicate he used this SSN while serving in the RA or USAR. 

3.  While it is understandable he desires to now record the requested SSN in his military records, there is not a sufficiently compelling reason for compromising the integrity of the Army's records.  Therefore, absent convincing independent and verifiable evidence to the contrary, it is presumed that his military service records, including the DD Form 214, were correct at the time and there is insufficient evidence to grant him relief in this case.

4.  For historical purposes, the Army has an interest in maintaining the accuracy of its records.  The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created.  In the absence of a showing of material error or injustice, there is a reluctance to recommend that those records be changed.

The evidence presented does not demonstrate the existence of a probable error or injustice.  Therefore, the Board determined that the overall merits of this case are insufficient as a basis to amend the decision of the ABCMR set forth in Docket Number AR20110014318, dated 12 January 2012.
