THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Armed Forces of the United States Repot of Transfer or Discharge) for the period ending 5 May 1967 to show his social security number (SSN) as xxx-xx-x0xx instead of xxx-xx-x8xx and his service number (SN) as RA xx xxx xx3 instead of RA xx xxx xx5.

2.  The applicant states the SSN and SN shown on the DD Form 214 are incorrect.

3.  The applicant provides:

* his National Guard Bureau (NGB) Form 22 (Report of Separation and Record of Service) for the period ending 22 March 1962
* his DD Form 214 for the period ending 5 May 1967

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a 

substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  The applicant enlisted in the Oregon Army National Guard (ORARNG) on
2 November 1960.  His DD Form 4 (Enlistment Record – Armed Forces of the United States) and DD Form 93 (Record of Emergency Data), both dated
2 November 1960, show the SSN and SN he claims are correct.

3.  He was ordered to active duty for training (ACDUTRA) from 22 July through 20 December 1961.  Upon his completion of ACDUTRA, he was issued a
DD Form 214 that shows the SSN and SN he claims are correct.

4.  He was honorably discharged from the ORARNG on 22 March 1962 for the purpose of enlisting in the Regular Army (RA).  The NGB Form 22 that he was issued at the time shows the SN he claims is correct.

5.  On 23 March 1962, he enlisted in the RA for a period of 3 years.  His DD Form 4 for this enlistment shows the SN he claims is correct.  It does not reflect an SSN.  On 6 May 1964, he was honorably discharged for the purpose of immediate reenlistment.  The DD Form 214 he was issued at the time shows the SN and SSN he claims is correct.  

6.  On 7 May 1964, he reenlisted for a period of 3 years.  His DD Form 4 for this period of service shows his SN as RA xx xxx xx5, the number he claims is incorrect.  It does not reflect an SSN.  He was honorably discharged at the expiration of his term of service on 5 May 1967.  The DD Form 214 he was issued at the time shows the service number and SSN he claims are incorrect.

7.  Army Regulation 635-5 (Separations Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It establishes standardized policy for the preparation of the DD Form 214.  It states the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty.  It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge.

DISCUSSION AND CONCLUSIONS:

The applicant's military records clearly show he initially served under the SSN and SN he claims are correct.  It appears an administrative error occurred in the preparation of his DD Form 214 for the period ending 5 May 1967 in that an incorrect SN and SSN were recorded.  Therefore, his DD Form 214 for the period ending 5 May 1967 should be corrected as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

	a.  deleting from item 2 (SN) of his DD Form 214 for the period ending 5 May 1967 the current entry and replacing it with the entry "RA" and the SN as shown on his DD Form 4 and DD Form 93 for the period ending 2 November 1960, and

	b.  deleting from item 3 (SSN) of his DD Form 214 for the period ending
5 May 1967 the current entry and replacing with the SSN entry as shown on his DD Form 4 and DD Form 93 for the period ending 2 November 1960.
