THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his foreign service in Kuwait.

2.  The applicant states when he was discharged [from active duty on 15 March 2011] the 6 months he spent in Kuwait was not included on his DD Form 214.

3.  The applicant provides his DD Form 214 for the period ending 15 March 2011, orders, a memorandum, and a DD Form 1610 (Request and Authorization for TDY Travel of DOD Personnel).

CONSIDERATION OF EVIDENCE:

1.  Having had prior active service, the applicant's records show he enlisted in the Army National Guard (ARNG) on 28 January 1999 and he held military occupational specialty 92Y (Unit Supply Specialist).  

2.  He served on active duty as a member of his ARNG unit from 17 February 2003 to 22 February 2005 and from 3 March 2005 to 9 May 2006.  He attained the rank of sergeant/E-5 on 13 June 2007.

3.  He was ordered to active duty for operational support and entered active duty on 16 March 2009.  He was attached to the U.S. Army Letterkeny Depot, Carlisle Barracks, PA.

4.  He was honorably released from active duty on 15 March 2011 and assigned to his ARNG unit.  He completed 2 years of creditable active service during this period of service.

5.  Item 12f (Foreign Service) of the DD Form 214 he was issued for this period of service shows he completed 11 months and 29 days of foreign service.  Item 18 (Remarks) does not contain any entries that show he served in Kuwait during this period of service.

6.  In an email received from the Defense Finance and Accounting Service (DFAS) on 3 August 2012, a DFAS official confirmed the applicant received hazardous fire/imminent danger pay (HF/IDP) for service in Kuwait from 15 September 2009 to 2 February 2010, or 4 months and 19 days.

7.  Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It establishes standardized policy for the preparation of the DD Form 214.  It states in item 18, for an active duty Soldier deployed to a foreign country, enter "SERVICE IN (Name of Country Deployed) FROM (inclusive dates, for example, YYYYMMDD-YYYYMMDD)."

DISCUSSION AND CONCLUSIONS:

1.  The evidence of record confirms the applicant served in Kuwait from 15 September 2009 to 2 February 2010 which is not shown in Item 18 of his DD Form 214 for the period ending 15 March 2011.  Therefore, he is entitled to correction of his DD Form 214 to show this foreign service.  

2.  In addition, as it is cannot be determined if he had foreign service in any other country during this period of service, no correction will be made to Item 12f of his DD Form 214 at this time.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to Item 18 of his DD Form 214 for the period ending 15 March 2011 the entry "SERVICE IN KUWAIT FROM 20090915-20100202."
