Issues: The applicant respectfully requests, in effect, for a second chance to prove that she is fully capable of becoming an “Excellent Soldier.”  She admits that she simply made a terrible judgment call that she truly regrets.  She states, she blames no one but herself.  Since the stupid mistake, she realizes now that she totally squandered a golden opportunity.  She pleads to, please consider providing her with another chance/opportunity to make a positive impact with the Army and her life—she loves the Army life and misses it very much.  She states, further, that she was at a very had place in her life and being new to the Army, she did not understand that she could truly turn to her chain of command for her mishap. She adds that it was a mistake, as she realizes now that she should have been totally honest and open about her problems with her chain of command, and asked for help.  Instead, she took what she thought was the way out, and tried to hide her problem.  She was not aware that the Army had and would offer help for any problems that Soldiers faced.  She has faced her issues, and would love another chance to make the transformation to a “Professional Soldier.”  It was her own doing when she made the stupid choice that cost her career.  Since her discharge, she knows now that her life has taken a change for the worst!  She made the decision to sabotage her own chance of having a great career.  She totally regrets making that choice!  She again pleads to please find it in your hearts to allow her a second chance, as everyone makes mistakes.  She can promise that she has learned her lesson and will never make that mistake again.  She apologizes for her mistake.  She expresses her appreciation to the Board to its kind consideration, as she prays that the Board considers providing her with another opportunity to prove herself.  She knows that she has what it takes to be a great Soldier.  (Note that the applicant provided a statement from a Veterans services counselor within her application.)

VI.  Facts, Circumstances, and Legal Basis for Separation

       a.  Facts and Circumstances:
       The applicant’s record is void of the specific facts and circumstances concerning the events which led to the discharge from the Army.  However, the record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was not authenticated by the applicant’s signature.  
       
       The DD Form 214 indicates the applicant was discharged under the provisions of Chapter 14, AR 635-200, paragraph 14-12c(2) by reason of misconduct for drug abuse, with a characterization of service of general, under honorable conditions.  
       
       Furthermore, the DD Form 214 shows a Separation Code of JKK (i.e., misconduct (drug abuse)) with a reentry eligibility (RE) code of "4."  

       b.  Legal Basis for Separation:  
       Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel.  Chapter 14 of this regulation establishes policy and prescribes procedures for separating members for misconduct.  Specific categories include minor disciplinary infractions, a pattern of misconduct, and commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave.  Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed.  Army policy states that an under other than honorable conditions discharge is normally considered appropriate; however, a general, under honorable conditions or an honorable discharge may be granted. 

       c.  Response to Issues, Recommendation and Rationale:  
       After a careful review of the entire applicant’s available military records, the issue and documents submitted with the application, the analyst found no mitigating factors which would merit an upgrade of the applicant’s discharge. 
       
       The applicant’s record is void of the specific facts and circumstances concerning the events that led to the former Soldier’s discharge from the Army.  However, the applicant’s record does contain a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was not authenticated by the applicant.  This document identifies the reason and characterization of the discharge and the analyst presumed government regularity in the discharge process.  
       
       The DD Form 214 indicates the applicant was discharged under the provisions of Chapter 14, AR 635-200, paragraph 14-12c(2) by reason of misconduct—commission of a serious offense (drug abuse), with a characterization of service of general, under honorable conditions.  Barring evidence to the contrary, the analyst was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process.  
       
       The applicant's contentions were carefully considered.  However, the analyst is unable to determine whether these contentions have merit because the facts and circumstances leading to the discharge are unknown.  The burden of proof remains with the former Soldier to provide the appropriate documents or other evidence sufficient to explain the facts, circumstances, and reasons underlying the separation action, for the Board's consideration.  If the applicant desires a personal appearance hearing, it will still be her responsibility to meet the burden of proof since the evidence is not available in the official record.
       
       The analyst noted the applicant's issues about her desire to rejoin the Service.  However, at the time of discharge the applicant was appropriately assigned a reentry eligibility (RE) code of “4.”  An RE code of “4” cannot be waived and the applicant is no longer eligible for reenlistment.  Furthermore, the narrative reason for separation is governed by specific directives.  The applicant was discharged under the provisions of Chapter 14, paragraph 14-12c(2), AR 635-200.  The narrative reason specified by Army Regulations for a discharge under this paragraph is "Misconduct (Drug Abuse)," the separation code is "JKK", and the reentry code is "RE 4".  Army Regulation 635-5, Separation Documents, governs preparation of the DD Form 214 and dictates that entry of the narrative reason for separation, entered in block 28, separation code, entered in block 26, and RE Code, entered in block 27 of the form, will be entered exactly as listed in tables 2-2 or 2-3 of AR 635-5-1, Separation Program Designator (SPD) Codes.  The regulation further stipulates that no deviation is authorized.  
       
       Therefore, based on the available evidence, the analyst presumes government regularity in the discharge process and concludes that it appears that the reason for discharge and the characterization of service were both proper and equitable and recommends to the Board to deny relief.
