THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests his DD Forms 214 (Certificate of Release or Discharge) be corrected by documenting his first period of service in Iraq and adding the Army Achievement Medal (AAM).
2. The applicant states the AAM was awarded after he retired and his first period of service in Iraq was overlooked.
3. The applicant provides his Enlisted Record Brief (ERB), DD Form 214, and AAM certificate in support of his request.
CONSIDERATION OF EVIDENCE:
1. The applicants record shows he served on active duty in the Regular Army from 4 January 2001 through 3 January 2004, at which time he was honorably released in the rank of specialist/E-4. The DD Form 214 he was issued at the time documents no overseas service in item 12f (Foreign Service) and documents no deployed service in item 18 (Remarks).
2. On 10 April 2008, the applicant reentered active duty in the Regular Army. His ERB shows, in Section I (Assignment Information-OS Deployment/Combat Duty), that he completed two tours in Iraq. The first Iraq tour was for 8 months from 23 January through 3 October 2003, and the second tour was for 1 month from 13 October through 15 November 2009. Section VIII (Awards and Decorations) includes the Global War on Terrorism Expeditionary Medal (GWOTEM) and Iraq Campaign Medal (ICM).
3. On 25 July 2011, the applicant was honorably retired by reason of disability, temporary. The DD Form 214 he was issued at the time documents 1 month of overseas service in item 12f. Item 18 contains an entry documenting his Iraq service from 13 October through 11 November 2009. The GWOTEM and ICM are included in the list of awards on this DD Form 214. The AAM is not included with the earned awards listed on the DD Form 214.
4. The applicant provides a certificate, dated 31 May 2011, which awarded him the AAM for meritorious service during the period 5 January through 15 May 2011. The certificate also shows this award was authorized and announced in official orders.
5. Army Regulation 635-5 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army. It also establishes standardized policy for preparing and distributing the DD Form 214. Chapter 2 contains item-by-item instructions for preparation of the DD Form 214. The instructions for Item 12f are to add all overseas service completed during the period covered by the DD Form 214. The instructions for item 13 (Decorations,. Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) are to add all awards earned during military service, and the instructions for item 18 are, in pertinent part, that for an active duty Soldier deployed with his or her unit during the period covered by the DD Form 214, the entry "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)" will be added to item 18.
DISCUSSION AND CONCLUSIONS:
1. The applicant's request that his DD Forms 214 be corrected by adding his first period of Iraq service and the AAM has been carefully considered and found to have merit.
2. In accordance with the regulation, overseas service completed during the period covered by a DD Form 214 will be added to item 12f and any deployment during the period of the DD Form 214 will be documented in item 18. The evidence of record confirms the DD Form 214 issued to the applicant on
3 January 2004 did not document his Iraq service in item 12f or item 18. Therefore, it would be appropriate to correct this DD Form 214 accordingly.
3. The certificate provided by the applicant confirms he awarded the AAM for meritorious service between 13 October and 11 November 2009 and that this
award was authorized and announced in official orders. As a result, it would be appropriate to add this award to the list of awards contained in item 13 of his
25 July 2011 DD Form 214.
