THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests that he be awarded the Army Good Conduct Medal (AGCM).
2. The applicant states that he served honorably for 5 years with no judicial or nonjudicial punishment imposed against him.
3. The applicant provides a copy of his DD Form 214 (Certificate of Release or Discharge from Active Duty).
CONSIDERATION OF EVIDENCE:
1. He enlisted in the Regular Army on 5 February 2004 for a period of 5 years. He completed his one-station unit training at Fort Leonard Wood, Missouri and was transferred to Germany on 1 July 2004. He was advanced to the pay grade of E-4 on 1 December 2005.
2. He deployed to Afghanistan from 28 February 2005 through 1 March 2006 and served in one campaign. He departed Germany on 30 July 2007 for assignment to West Point, New York where he remained until he was honorably released from active duty (REFRAD) on 4 February 2009. His DD Form 214 issued at the time of his REFRAD shows that he was awarded the Army Achievement Medal (2d award), Joint Meritorious Unit Award, National Defense Service Medal, Afghanistan Campaign Medal, Global War on Terrorism Service Medal, Army Service Ribbon, Overseas Service Ribbon (2d award), NATO Medal, and the Combat Action Badge.
3. A review of his official records failed to show any evidence of any derogatory information or information that would serve to disqualify him for award of the AGCM. There is also no evidence of him being disqualified by his commander.
4. Army Regulation 600-8-22 (Military Awards) states the Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified.
5. Army Regulation 600-8-22 states the Afghanistan Campaign Medal is awarded to members who have served in direct support of Operation Enduring Freedom (OEF). A bronze service star is authorized for wear with this medal for participation in each credited campaign. Approved designated Afghanistan campaigns are:
* Liberation of Afghanistan (11 September 2001-30 November 2001)
* Consolidation I (1 December 2001-30 September 2006)
* Consolidation II (1 October 2006-date to be determined)
DISCUSSION AND CONCLUSIONS:
1. After carefully examining the applicant's record of service, it appears the applicant should have received the first award of the AGCM for his service from 5 February 2004 through 4 February 2007. His record is void of any derogatory information or any specific action by his commander to disqualify him from receiving this award which would have precluded him from being awarded the AGCM.
2. The evidence further suggests the applicant did not receive the AGCM as a result of an administrative error. Therefore, the applicant should be awarded the first award of the AGCM and his DD Form 214 should be corrected to show this award.
3. The applicant also served in Afghanistan during one campaign and is authorized to be awarded one bronze service star for wear on his already-awarded Afghanistan Campaign Medal.

BOARD DETERMINATION/RECOMMENDATION:
1. The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:
* Deleting his award of the Afghanistan Campaign Medal from his DD Form 214
* awarding him the AGCM (first award) for the period 5 February 2004 through 4 February 2007
* Adding the awards of the AGCM and the Afghanistan Campaign Medal with one bronze service stars to his DD Form 214
2. The Board wants the applicant and all others to know that the sacrifices he made in service to the United States during the Global War on Terrorism are deeply appreciated. The applicant and all Americans should be justifiably proud of his service in arms.
