THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration for correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show award of the Combat Infantryman Badge (CIB).

2.  The applicant states he was awarded the CIB, but he never received orders for it and it does not appear on his DD Form 214.

3.  The applicant provides the flyer from his unit's CIB pinning ceremony.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20100024235 on 31 March 2011.

2.  The applicant provides a CIB pinning ceremony flyer which was not previously considered.  Therefore, it is new evidence and warrants consideration by the Board.

3.  During the original review of the case, the Board concluded that although the evidence confirmed he held an infantry military occupational specialty, there was no evidence confirming his participation in ground combat with enemy forces in Iraq that would support award of the CIB.  However, his record was corrected to show award of the Army Achievement Medal, Army Good Conduct Medal, Iraq Campaign Medal with two bronze service stars, and Global War on Terrorism Service Medal.

4.  The applicant provided a flyer from his unit's CIB Pinning ceremony.  An ABCMR staff member reviewed the official military personnel files for several Soldiers listed in the flyer and located Permanent Orders 229-37 with an attached list of Soldiers from the 74th Infantry Detachment (Long Range Surveillance), Camp Ederle, Germany, awarding the CIB during the period 11 April 2003 to 8 June 2003 for participating in combat operations under enemy hostile fire to liberate Iraq in support of Operation Iraqi Freedom.  The applicant's name appears on the attached list.

DISCUSSION AND CONCLUSIONS:

1.  The applicant requests reconsideration of his request for correction of his DD Form 214 to show award of the CIB.

2.  Permanent orders awarded him the CIB.  Therefore, he is entitled to correction to his DD Form 214 to show this award.
