THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of item 9 (Command to Which Transferred) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show the entry "none."

2.  The applicant states that upon reporting to the unit, no record of enlistment or assignment orders were found and the U.S. Army Human Resources Command (USAHRC) notified that no orders were made.

3.  The applicant provides a DD Form 214.

CONSIDERATION OF EVIDENCE:

1.  After having had prior service in the U.S Air Force and Army National Guard, the applicant enlisted in the Regular Army on 5 July 2006.

2.  His Official Military Personnel File (OMPF) contains a DA Form 5691-R (Request for Reserve Component Assignment), dated 25 March 2010, that indicates the applicant was to enlist in the U.S. Army Reserve (USAR) and that upon completion of his active duty service, he had voluntarily accepted an assignment to 1BN (BCT), 415th, 6201 E. Oak Street, Phoenix, AZ.

3.  His OMPF also contains an enlistment/reenlistment contract which shows that on 25 March 2010, he enlisted in the USAR for a period of two years.

4.  His OMPF further contains Joint Base Lewis-McChord, WA, Orders Number 089-0024, dated 30 March 2010, which directed his release from active duty effective 8 May 2010.  These orders also directed his reassignment to 1BN (BCT), 415th, 6201 E. Oak Street, Phoenix, AZ.

5.  He was released from active duty on 8 May 2010.  Item 9 of his DD Form 214 shows he was transferred to the 1BN (BCT), 415th, 6201 E. Oak Street, Phoenix, AZ.

6.  Army Regulation 635-5 (Separations Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army.  It establishes standardized policy for the preparation of the DD Form 214.  It states the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty.  It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge.

DISCUSSION AND CONCLUSIONS:

1.  A DA Form 5691-R shows he voluntarily accepted an assignment to 1BN (BCT), 415th, 6201 E. Oak Street, Phoenix, AZ upon his release from active duty and entry into the USAR.

2.  Joint Base Lewis-McChord, WA, Orders Number 089-0024, dated 30 March 2010, directed his reassignment to the above mentioned unit.  Therefore, his contention that upon reporting to the unit no record of enlistment or assignment orders were found is not supported by the available evidence contained in his OMPF.  

3.  In the absence of evidence indicating his USAR enlistment and separation orders are incorrect, there is no basis to grant the requested relief.
