BOARD DATE: 29 March 2012
DOCKET NUMBER: AR20110018597
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his date of birth (DOB) as 9 Axxxxx xxxx instead of 8 Axxxxx xxxx.
2. The applicant states:
* his DOB contains a mistake
* his DOB is 9 Axxxxx xxxx
3. The applicant provides his birth certificate.
CONSIDERATION OF EVIDENCE:
1. The applicant enlisted in the Regular Army on 23 January 1990. His original enlistment contract shows his DOB as 8 Axxxxx xxxx but his birth certificate shows his DOB as 9 Axxxxx xxxx and the birth certificate was included in his original enlistment packet.
2. He served as a mechanic maintenance supervisor and remained on active duty through continuous reenlistments. On 31 July 2010, he retired in the rank of first sergeant.
3. Item 5 (DOB) of his DD Form 214 shows his DOB as 8 Axxxxx xxxx.
4. All of his service personnel records show his DOB as 8 Axxxxx xxxx.
5. He provides a birth certificate that shows his DOB as 9 Axxxxx xxxx.
DISCUSSION AND CONCLUSIONS:
1. The applicant contends he was born on 9 Axxxxx xxxx and his birth certificate supports this contention. His birth certificate was included in his 1990 enlistment contract.
2. Based on the foregoing, it would be appropriate to correct item 5 of his DD Form 214 to show his DOB as 9 Axxxxx xxxx.
