THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of the portion of his earlier request for correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show two awards of the Bronze Star Medal.

2.  The applicant states he has located the General Orders (GO) that awarded him the Bronze Star Medal (1st Oak Leaf Cluster).

3.  The applicant provides GOs Number 4048, dated 19 March 1970.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20110000340, on 21 July 2011.

2.  The applicant provides a copy of the GOs that awarded him the second award of the Bronze Star Medal, which was not previously available to the ABCMR; therefore, it is considered new evidence and as such warrants consideration by the Board.

3.  The applicant enlisted in the Regular Army on 18 June 1965 and he held military occupational specialty (MOS) 56E (Stevedore).  He served in the Republic of Vietnam from on or about 10 September 1967 to on or about 12 February 1968.
4.  While in Vietnam, he was honorably discharged on 17 July 1967 for the purpose of immediate reenlistment.  His DD Form 214 for this period shows the:

* National Defense Service Medal
* Vietnam Service Medal
* Republic of Vietnam Campaign Medal
* Expert Marksmanship Qualification Badge w/Automatic Rifle Bar
* Sharpshooter Marksmanship Qualification Badge w/Rifle Bar
* Marksman Marksmanship Qualification Badge w/Mortar Bar

5.  He reenlisted on 18 July 1967 and held MOS 57A (Cargo Handler).  He again served in the Republic of Vietnam from on or about 3 October 1968 to on or about 18 March 1970.  He was honorably released from active duty on 22 March 1970.  His DD Form 214 for this period of service shows the 

* National Defense Service Medal
* Vietnam Service Medal
* Republic of Vietnam Campaign Medal
* Air Medal

6.  Headquarters, 1st Cavalry Division, published the following GOs:

* GOs Number 2576, dated 23 April 1968, awarded him the Bronze Star Medal for service from March 1967 to March 1968.
* GOs Number 4048, dated 19 March 1970, awarded him the Bronze Star Medal (1st Oak Leaf Cluster) for service from October 1968 to March 1970

7.  On 17 October 2011, he was issued a DD Form 215 (Correction to DD Form 214 (Certificate of Release or Discharge from Active Duty)) that deleted from his March 1970 DD Form 214 the Vietnam Service Medal, Air Medal, and Vietnam Campaign Medal.  It also added the:

* Bronze Star Medal
* Purple Heart
* Air Medal w/Numeral 4
* Army Good Conduct Medal
* Vietnam Service Medal w/one silver and three bronze service stars
* Combat Infantryman Badge
* Meritorious Unit Commendation (2nd Award)
* Republic of Vietnam Gallantry Cross w/Palm Unit Citation (3rd Award)
* Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation 
* Republic of Vietnam Campaign Medal w/Device (1960)
DISCUSSION AND CONCLUSIONS:

GOs awarded the applicant two awards of the Bronze Star Medal, one of which is not listed on his DD Form 214.  Therefore, he is entitled to correction of his DD Form 214 to show both awards.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number Docket Number AR20110000340, on 21 July 2011.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting from his DD Form 214 for the period ending 22 March 1970 the Bronze Star Medal and adding the Bronze Star Medal (2nd Award).
