		IN THE CASE OF:

		BOARD DATE:  6 March 2012

		DOCKET NUMBER:  AR20110018012

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be corrected to show his date of birth (DOB) as 8 December 1927.

2. The applicant states the DOB is incorrectly listed on his DD Form 214.

3. The applicant provides copies of his DD Form 214 and Certificate of Birth, North Carolina showing his DOB as 8 December 1927.

CONSIDERATION OF EVIDENCE:

1. The applicant is a retired U.S. Army Reserve (USAR) lieutenant colonel.

2. His records contain numerous documents showing the DOB of 8 December 1928. Among the documents are:

* DA Form 61 (Application for Appointment)
* SF 88 (Report of Medical Examination), dated 20 July 1954
* DA Form 1140 (Army Reserve Qualification and Availability Statement)
* Headquarters, Minnesota Military District assignment orders
DA Form 428 (Application for Identification Card
* SF 88, dated 5 March 1973
* DA Form 66 (Officer Qualification Record)
* DD Form 214

3. His records contain the following document showing his DOB as 8 December 1927:

* TAGD Form 109 (Request for Statement of Service)
* DA Form 873 (Certificate of Clearance and/or Security Determination)
* AGPZ Form 61 (Computation of Officer's Service)

4. Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. The regulation directs that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It is important that information entered on the form should be complete and accurate.

DISCUSSION AND CONCLUSIONS:

1. Although most of his records show the DOB of 8 December 1928, his records do contain documents that indicate the DOB of 8 December 1927, which he claims is correct.

2. In view of the foregoing, there is sufficient evidence for granting the applicant's request to correct his DD Form 214.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by

deleting from item 9 (Date of Birth) of his DD Form 214 the entry 8 December 1928, and replacing it with the entry 8 December 1927.

    The applicant's military record is not available to the Board for review. This case is being considered using reconstructed records, which primarily consist of his DD Form 214, three Standard Forms (SF) 88 (Report of Medical Examination) provided by the National Personnel Records Center (NPRC), and an undated SF 180 (Request Pertaining to Military Records) the applicant submitted to the NPRC. The evidence of record shows his date of birth consistently appeared as 1 August 1928 on every...

    The applicant requests correction of his DD Form 214 (Report of Separation from the Army Forces of the United States) to show his correct date of birth (DOB). The evidence of record shows the applicant's DOB is 17 July 1928 and that his DOB is correctly recorded on his SF 88 and in the National Archive's recordkeeping system for veterans. Therefore, it would be appropriate at this time to correct his DD Form 214 to show his correct DOB.

    The applicant's military service records are not available to the Board for review. The applicant contends that the first name and DOB shown on his DD Form 214 should be corrected because he lied about his age when he entered military service, he was afraid to correct the misspelling of his first name and his DOB, and they do not correspond with the first name and DOB shown on his birth certificate and VA records. Thus, there is no basis for granting the applicant's request to change the...

    The applicant requests that his date of birth on his 1953 DD Form 214 (Report of Separation from the Armed Forces of the United States) be corrected and that item 26 (foreign and/or sea service) be corrected to reflect a total of 36 months of overseas service. The applicant's service personnel records were not available to the Board. The applicant requests correction of his records to show his correct date of birth (DOB). This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. The applicant's request for correction of his records to show his correct date of birth is supported by the evidence.
