THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests her record be corrected to show a basic appointment date of 21 March 2011.
2. The applicant states she reported to the Basic Officer Leader Course (BOLC) on 23 March 2011; however, she had been authorized 2 days of travel in her active duty orders so her appointment date should be 21 March 2011.
3. The applicant provides the following documents in support of her application:
* Active Duty Orders
* DA Form 71 (Oath of Office)
* Marriage Certificate
* Legal Name Change Memorandum
* Officer Record Brief (ORB)
CONSIDERATION OF EVIDENCE:
1. The applicants record contains Headquarters, United States Army Cadet Command Orders 060-002-A-3600, dated 1 March 2011, which assigned her to the U.S. Army Medical Department Activity (MEDDAC), Fort Hood, Texas, with temporary duty at Fort Sam Houston, Texas, to attend the BOLC. The orders also contained additional instructions stipulating the applicant would commence travel not earlier than 21 March 2011, and that she would be accessed for the month of March 2011, and enter active duty effective 21 March 2011.
2. In connection with the processing of this case an advisory opinion was obtained from the United States Army Cadet Command (USACC) Executive Officer to the USACC Command Nurse. This official states the applicants request should be favorably considered. She indicates in accordance with the applicable law, members will enter active duty on the date they begin travel, and the applicants orders stipulated she begin travel on 21 March 2011.
3. Army Regulation 601-100 (Appointment of Commissioned and Warrant Officers in the Regular Army (RA)) prescribes policy, eligibility requirements, and administrative procedures for the appointment of commissioned and warrant officers of the RA). It states the U.S. Army Human Resources Command or one of the special branches, as appropriate, will give assignment instructions for appointees in the RA and who were not on active duty as commissioned officers before their appointment.
DISCUSSION AND CONCLUSIONS:
1. The applicants contention that her initial appointment date should be
21 March 2011 vice 23 March 2011 based on her initial RA assignment orders authorizing her to travel on that date has been carefully considered and found to have merit.
2. The evidence of record confirms the applicants initial RA assignment orders contained instructions authorizing her to begin travel on 21 March 2011, and that stipulated her active duty accession date would be 21 March 2011. As a result, it would be appropriate to correct her record to show her initial appointment date as 21 March 2011, the date she entered active duty in the RA.
