THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) for the period ending 27 December 1971 to show award of the Presidential Unit Citation and he would like to receive this award.

2.  In a telephonic conversation on 20 December 2011, between the analyst of record and the applicant, the applicant stated he meant to ask for the correction of his records to show the Valorous Unit Award.

3.  The applicant states he just found out his unit was awarded the Valorous Unit Award and would like a DD Form 215 (Correction to DD Form 214) issued to show this award.

4.  The applicant provides two DD Forms 214, DD Form 215, and orders.

CONSIDERATION OF EVIDENCE:

1.  Having had previous enlisted service, the applicant's records show he was appointed as a 100B Army Aviator warrant officer in the U.S. Army Reserve on 30 November 1970 and entered active duty that date.  He served in Vietnam from 6 January to 26 May 1971 while assigned to the 174th Aviation Company, 23rd Infantry Division.

2.  He was medically evacuated from Vietnam on 27 May 1971, due to wounds received in action, and he was assigned to Japan in a patient status.
3.  He was honorably retired from active duty on 27 December 1971.  He completed 1 year and 28 days of creditable active service during this period of service.

4.  Item 24 (Decorations, Medals, Badges, Commendations, Citations, and Campaign Ribbons Awarded or Authorized) of this DD Form 214 shows the:

* Army Aviator Badge
* Army Good Conduct Medal (1st Award)
* Vietnam Service Medal
* Bronze Star Medal
* Sharpshooter Marksmanship Qualification Badge with Rifle Bar (M-16)
* Sharpshooter Marksmanship Qualification Badge with Hand Gun Bar (38 Pistol)

5.  A DD Form 215, dated 23 July 2002, deleted the Vietnam Service Medal from item 24 of his DD Form 214 for the period ending 27 December 1971 and added the:

* Vietnam Service Medal with one bronze service star
* Republic of Vietnam Gallantry Cross with Palm Unit Citation
* Purple Heart
* Silver Star

6.  The applicant provides Permanent Orders 089-10, dated 30 March 2010, issued by the U.S. Army Human Resources Command, wherein the 174th Aviation Company was cited for award of the Valorous Unit Award for the period 8 February to 7 April 1971.

7.  Army Regulation 600-8-22 (Military Awards) states the Republic of Vietnam Campaign Medal with Device (1960) was awarded by the Government of Vietnam to all members of the Armed Forces of the United States for qualifying service in Vietnam during the period 1 March 1961 through 28 March 1973.  Qualifying service included assignment in Vietnam for 6 months or more.  Individuals who had qualified for award of the Vietnam Service Medal and were evacuated prior to completing six months of service due to wounds resulting from hostile action were entitled to award of the Vietnam Campaign Medal.

DISCUSSION AND CONCLUSIONS:

1.  The evidence of record shows the applicant was assigned to the 174th Aviation Company during the period this unit was cited for award of the Valorous Unit Award.  Therefore, he is entitled to correction of his DD Form 214 to show this unit award.

2.  He served in Vietnam during a qualifying period for award of the Republic of Vietnam Campaign Medal with Device (1960).  Although he served in Vietnam for less than six months, he was evacuated due to wounds resulting from hostile action.  Therefore, he is entitled to correction of his DD Form 214 to show this award.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to item 24 of his DD Form 214 for the period ending 27 December 1970 the Valorous Unit Award and the Republic of Vietnam Campaign Medal with Device (1960) and issuing him these awards.
