THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Report of Separation from Active Duty) to show his social security number (SSN) as "xxx-xx-xxx8" as shown on his Social Security card instead of "xxx-xx-xxx0."

2.  The applicant states his SSN was entered incorrectly on his DD Form 214.

3.  The applicant provides:

* his DD Form 214
* Social Security card
* Social Security Administration SSN Printout

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to 


timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  The applicant was inducted into the Army of the United States on 19 October 1967.  At that time, Soldiers were assigned a military service number and not identified or managed by their SSN.

3.  His official military personnel file (OMPF) contains the following documents that show the same SSN as indicated on his Social Security card and Social Security Administration SSN Printout.

* DD Form 47 (Record of Induction), dated 19 October 1967
* Special Orders Number 204, issued by the Armed Forces Examining and Entrance Station, Oakland, CA, dated 19 October 1967
* DD Form 398 (Statement of Personal History), dated 18 October 1967
* DD Form 1584 (National Agency Check Request), dated 25 October 1967
* Security Termination Statement and Debriefing Certificate, dated 25 April 1967
* DA Form 20 (Enlisted Qualification Record), prepared on 25 October 1967

4.  On 26 August 1969, the applicant was released from active duty and transferred to the U.S. Army Reserve (USAR) Control Group (Annual Training) to complete his remaining Reserve obligation.  He completed 1 year, 10 months, and 8 days of total active service.

5.  Item 3 (Social Security Number) of the applicant's DD Form 214 shows a number different from that used in his military records.

6.  The applicant provided a copy of his Social Security card and a printout from the Social Security Administration showing an account number different from that entered on his DD Form 214, but the same as the SSN used throughout his OMPF.

7.  Army Regulation 635-5 (Separation Documents) as in effect at the time, required entry of the SSN in Item 3 of the DD Form 214.

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that his DD Form 214 should be corrected to show his SSN as shown on his Social Security card.


2.  The evidence of record clearly shows that the applicant's SSN during the period of his active duty service was the same as the SSN shown on his Social Security card.  Furthermore, a review of his DD Form 214 clearly shows the SSN entered in Item 3 was incorrectly enters as a result of an administrative error.

3.  In view of the foregoing, the applicant’s DD Form 214 should be corrected as recommended below.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting from Item 3 of his DD Form 214 the current entry and replacing it with the SSN as shown on his Social Security card.
