IN THE CASE OF:
BOARD DATE: 17 November 2011x
DOCKET NUMBER: AR20110011107
THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:
1. Application for correction of military records (with supporting documents provided, if any).
2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests, in effect, correction of the appropriate records to show she requested entitlement to Survivor Benefit Plan (SBP) benefits based on the death of her husband, a former service member (FSM), in a timely manner.
2. The applicant states she was not notified of her entitlement to SBP benefits until 28 January 2011 when she received a letter stating she did not file within the required timeframe.
3. The applicant provides a certificate of death and two letters.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicants failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicants failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. Having had prior active service, the FSM's records show he enlisted in the Regular Army on 17 May 1977. He served through multiple reenlistments in staff and leadership positions and attained the rank/grade of staff sergeant/E-6.
3. He and the applicant were married on 24 November 1983.
4. He was honorably retired from active duty on 31 August 1992 and placed on the Retired List on 1 September 1992. He completed 20 years and 26 days of creditable active service.
5. A DA Form 4240 (Data for Payment of Retired Army Personnel), dated 31 August 1992, shows he elected SBP for spouse coverage in the full amount.
6. The applicant provides a death certificate, dated 26 February 1998, wherein it shows the FSM died on 9 February 1998. This certificate also shows he was married to the applicant at the time of his death.
7. She also provides a letter, dated 19 January 2011, to her from the Defense Finance and Accounting Service (DFAS) Retired and Annuity Pay Branch, wherein it was stated they were sorry to hear of the death of her husband and that a form was being enclosed for her to complete. She also provides an undated letter from DFAS wherein it was stated that upon retirement the FSM did elect spouse coverage under the SBP program; however, payment could not be made regardless of entitlement because the 6-year statute of limitations had expired.
DISCUSSION AND CONCLUSIONS:
The evidence of record shows the applicant was entitled to the SBP annuity based on the death of the FSM on 9 February 1998. Therefore, the record should be corrected to show she applied for the SBP annuity in February 1998.
BOARD VOTE:

BOARD DETERMINATION/RECOMMENDATION:
The Board determined that the evidence presented was sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing she applied for the SBP annuity in February 1998 and that she be paid the SBP annuity, provided she otherwise meets the eligibility criteria, retroactive to 10 February 1998.

The applicant married the FSM in "1995," but he did not inform DFAS within a year of the marriage, so the applicant was not eligible. DFAS issued the applicant two payments which were later collected because she was not entitled to an SBP annuity because the FSM was not married at the time of his retirement and had not elected coverage for her within one year of their marriage. As a result, the Board recommends that all Department of the Army records of the FSM be corrected by showing that...

The applicant states: * the FSM died on 1 February 2013; he had paid into the SBP for his mentally handicapped son for 30 years * before his death, he appointed his daughter Victoria as his surrogate (a person in charge of probate, inheritance, and guardianship) * the handicapped son began receiving monthly annuity payments in August 2013 but those payments suddenly stopped in November 2013 * when payments stopped, officials at the Defense Finance and Accounting Service (DFAS) demanded...

The applicant requests correction of the records of her late husband, a former service member (FSM), as follows: * by showing he timely elected to change his election in the Reserve Component Survivor Benefit Plan (RCSBP) from spouse to former spouse coverage on 19 November 1994 * by showing the Defense Finance and Accounting Service (DFAS) timely processed this change in election * by paying her an SBP annuity as the former spouse retroactive to the date of the FSM's death on 6 March...

According to the applicant, she and the FSM divorced on 1992. There is no evidence the FSM or the applicant made a deemed election to change his SBP coverage from spouse to former spouse coverage within 1 year of their divorce. Title 10, U.S. Code, section 1450(f)(3)(A), permits a former spouse to make a written request that an SBP election of former spouse coverage be deemed to have been made when the former spouse is awarded the SBP annuity incident to a proceeding of divorce.

The applicant requests, in effect, correction of the records of her deceased former husband, a former service member (FSM), to show he changed his Survivor Benefit Plan (SBP) coverage from "spouse" to "former spouse" and payment of the SBP annuity based on his death. Public Law 99-661, dated 14 November 1986, permitted divorce courts to order SBP coverage without the member's agreement in those cases where the retiree had elected spouse coverage at retirement or was still on active duty and...

A letter, dated 20 October 2000, wherein the ALARNG State Military Department provided her a DD Form 1998 (Application for Annuity) to complete and file for compensation. The applicant stated she submitted a request for an SBP annuity as early as 2000 and the HRC letter, dated 14 November 2000, notified her of the receipt of her claim. That letter does not indicate she was advised of entitlement to an RCSBP or SBP annuity starting at age 60.

The applicant states: * she and the FSM gave the best years of their lives to the Army * the only reason she divorced the FSM is because of what Operation Desert Storm did to him; he came back a different man * their divorce decree clearly stipulated that she was to be the beneficiary under the SBP at the FSM's expense * the FSM paid SBP premiums from his retired pay each and every month * in spite of their divorce, she and the FSM spoke at least once a week * when the FSM knew he was dying...

Counsel requests the records of the applicant's deceased former husband, a former service member (FSM), be corrected to show he changed his Survivor Benefit Plan (SBP) coverage from "spouse" to "former spouse" within 1 year of his divorce and the SBP annuity be paid to her. The Board previously twice denied the applicant's request because the FSM did not change his SBP election from "spouse" to "former spouse" and the applicant did not deem the election within one year of her divorce. ...

The applicant requests payment of the Survivor Benefit Plan (SBP) annuity based on the death of her former husband, a former service member (FSM). She was married to him for 29 years. The applicant contends the records of her deceased former husband should be corrected to show he timely changed his SBP coverage from "spouse" to "former spouse" coverage pursuant to their divorce decree and that she be paid the SBP annuity based on his death.
