		IN THE CASE OF:

		BOARD DATE: 10 November 2011

		DOCKET NUMBER: AR20110009880

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1. Application for correction of military records (with supporting documents provided, if any).

2. Military Personnel Records and advisory opinions (if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his home of record (HOR) as Killeen, TX.

2. The applicant states he has resided in Texas since April 1995, prior to retirement.

3. The applicant did not provide any additional documentation.

CONSIDERATION OF EVIDENCE:

1. The applicant enlisted in the U.S. Army Reserve on 2 September 1987. He enlisted in the Regular Army on 10 February 1988 and served continuously, without a break in service, until his retirement.

2. His official records contain four DD Forms 4 (Enlistment/Reenlistment Document). All four forms list his HOR as Rialto, CA.

3. His 14 April 2008 Enlisted Record Brief Section IV (Personal/Family Data) lists his HOR as Rialto, CA.

4. His 30 September 2008 DD Form 214, item 7b (HOR) lists Rialto, CA.

5. Army Regulation 601-280 (Army Reenlistment Program) provides instructions for completing the DD Form 4. Item 3 (HOR) provides for:

   a. U.S. Army Reserve - enter the address the Soldier claims as a permanent address (street, city, state to be spelled out).

   b. Regular Army - enter the street, city, state and zip code of the HOR. HOR is the place recorded as the home of the Soldier when enlisted. The place recorded as the HOR for the Soldier when the Soldier reenlisted remains the same as that recorded when he enlisted unless there is a break in service of more than one full day. Only if a break in service exceeds one full day can the HOR be changed by the Soldier.

DISCUSSION AND CONCLUSIONS:

1. The applicant contends his HOR should be recorded on his DD Form 214 as Killeen, TX.

2. The available evidence shows the applicant designated his HOR as Rialto, CA when he initially enlisted, and used that HOR throughout his career. He did not have a break in service. Therefore, he was never authorized to change his HOR.

3. In view of the foregoing, the applicant's request should be denied.

BOARD VOTE:

________ ________ ________ GRANT FULL RELIEF

________ ________ ________ GRANT PARTIAL RELIEF

________ ________ ________ GRANT FORMAL HEARING

____X____ ____X____ ____X____ DENY APPLICATION

BOARD DETERMINATION/RECOMMENDATION:

The evidence presented does not demonstrate the existence of a probable error or injustice. Therefore, the Board determined that the overall merits of this case are insufficient as a basis for correction of the records of the individual concerned.

Application for correction of military records (with supporting documents provided, if any). The applicant requests correction of item 7b (Home of Record) of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show her home of record (HOR) as Killeen, TX, instead of Miami, FL. Therefore, there is insufficient evidence on which to base correction of her records to show her HOR as Killeen, TX.

The applicant requests correction of his records to show his home of record (HOR) is Texas. The evidence of record shows that item 7b of the applicant's DD Form 214 shows the place recorded as the HOR of the applicant when he enlisted in the U.S. Army. A DD Form 214 shows the applicant entered active duty on 7 January 2005, she was honorably REFRAD on 6 February 2006 based on completion of required active service. The evidence of record also shows the applicant had continuous service as a member of the USAR from 31 January 2000 through the date she was REFRAD on 6 February 2006. b. Thus, records show the applicant's HOR was incorrectly recorded on her orders when she was ordered to active duty in support of OEF on 7 January 2005.

Item 5 (HOR) of his DD Form 4 (Enlistment/ Reenlistment Document) shows his HOR as "Fairfield, CA 94533" and item 6 (Place of Enlistment/Reenlistment) shows the entry "Oakland, CA." The DD Form 214 is prepared for all personnel at the time of their retirement, discharge, or release from active duty. Oakland, CA, was correctly established as the place of entry on active duty and Fairfield, CA, as his HOR.
