THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

2. Military Personnel Records and advisory opinions (if any).
THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests to be awarded the Purple Heart.
2. The applicant states he was wounded in action behind his right ear by shrapnel when his compound in Vietnam came under rocket or mortar attack in February 1970. He was treated by the medical corpsman.
3. The applicant provides no additional evidence.
CONSIDERATION OF EVIDENCE:
1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.
2. The applicant's service medical and dental records are believed to be on permanent loan to the Department of Veterans Affairs and are not available for review.
3. The applicant was inducted into the Army of the United States and served on active duty from 14 January 1969 through 9 October 1970.
4. He served in Vietnam as a radio teletype operator with Headquarters and Headquarters Battery, 7th Battalion, 9th Artillery, and with Headquarters and Headquarters Battery, 5th Battalion, 42nd Artillery, from 5 October 1969 to 6 October 1970.
5. Neither his DA Form 20 (Enlisted Qualification Record) nor his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) shows he received any wounds or award of the Purple Heart.
6. A review of the Vietnam casualty roster did not locate any reference to the applicant.
7. A review of the Awards and Decorations Computer-Assisted Retrieval System, an index of general orders issued during the Vietnam era between 1965 and 1973 maintained by the Military Awards Branch of the U.S. Army Human Resources Command, failed to reveal any awards pertaining to the applicant.
8. Army Regulation 600-8-22 (Military Awards) states the Purple Heart is awarded for a wound sustained in action against an enemy or as a result of hostile action. Substantiating evidence must be provided to verify the wound was the result of hostile action, the wound must have required treatment by medical personnel, and the medical treatment must have been made a matter of official record.
9. Army Regulation 15-185 (Army Board for Correction of Military Records) prescribes the policies and procedures for correction of military records by the Secretary of the Army acting through the ABCMR. Paragraph 2-9 states the ABCMR begins its consideration of each case with the presumption of administrative regularity. The applicant has the burden of proving an error or injustice by a preponderance of the evidence.
DISCUSSION AND CONCLUSIONS:
1. The applicant has not provided any evidence to validate his contention and the official record does not contain any indication the applicant was wounded as the result of hostile action.
2. Without verification that he was wounded and received medical treatment for the wound, no relief is warranted.
