THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he served in the imminent danger pay (IDP) areas of Southwest Asia (SWA) in support of Operation Desert Shield/ Storm (ODS) and in the former Republic of Yugoslavia in support of Operation Joint Guard (OJG).

2.  The applicant states he served in SWA (ODS) from 15 December 1990 to
4 May 1991 and in Kosovo or Macedonia (Task Force Dragon) from 21 January to 10 May 2001.  He adds his service medals for these deployments are on his DD Form 214; however, his overseas deployments are not.

3.  The applicant provides copies of his deployment documents, an evaluation report, and two certificates.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army and entered active duty on 14 April 1983.

2.  The applicant's Enlisted Record Brief, dated 21 January 2009, shows in:

	a.  section I (Assignment Information):   military occupational specialty  (MOS) 63Z (Mechanic Maintenance Supervisor);


	b.  section III (Service Data):  he was promoted to first sergeant (pay grade
E-8) on 1 January 2003; and

	c.  section VIII (Awards and Decorations):  Legion of Merit, Bronze Star Medal, Meritorious Service Medal, Army Commendation Medal (9th Award), Army Achievement Medal (7th Award), Army Good Conduct Medal (8th Award), National Defense Service Medal (2nd Award), Korea Defense Service Medal, Southwest Asia Service Medal with 1 bronze service star, Global War on Terrorism Service Medal, Humanitarian Service Medal, Noncommissioned Officer Professional Development Ribbon with Numeral "3", Army Service Ribbon, Overseas Service Ribbon with Numeral "4", Kuwait Liberation Medal (Saudi Arabia), Kuwait Liberation Medal (Kuwait), North Atlantic Treaty Organization (NATO) Medal, Parachutist Badge, and Driver and Mechanic Badge.

3.  The applicant's DD Form 214 shows he entered active duty this period on
14 April 1983, was honorably retired on 30 April 2009 based on sufficient service for retirement, and he was transferred to the U.S. Army Reserve Control Group (Retired).  He completed 26 years and 17 days of net active service.  It shows in:

	a.  item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized):  Legion of Merit, Bronze Star Medal, Meritorious Service Medal, Army Commendation Medal (9th Award), Army Achievement Medal
(7th Award), Army Good Conduct Medal (8th Award), National Defense Service Medal (2nd Award), Southwest Asia Service Medal with bronze service star, Global War on Terrorism Service Medal, Korea Defense Service Medal, Humanitarian Service Medal, Noncommissioned Officer Professional Development Ribbon with Numeral "3", Army Service Ribbon, Overseas Service Ribbon with Numeral "4", NATO Medal, Kuwait Liberation Medal (Saudi Arabia), Kuwait Liberation Medal (Kuwait), Parachutist Badge, and Driver and Mechanic Badge with Mechanic Bar; and

	b.  item 18 (Remarks), in pertinent part, "Served in a Designated Imminent Danger Pay Area//Service in Iraq 20050608-20060526."

4.  In support of his request, the applicant provides the following documents:

	a.  Task Force 8 - 43rd Air Defense Artillery, VII Corps, memorandum, dated 18 March 1991, that shows the commanding officer certified the applicant arrived in SWA on 15 December 1990, departed SWA on 4 May 1991, and he was entitled to hazardous duty pay (HDP) [during the period].

	b.  DA Form 2166-7 (NCO [Noncommissioned Officer] Evaluation Report) for the period December 1990 through May 1991 that shows the applicant served as Platoon Maintenance Supervisor (MOS 63B2O) and he was responsible for inspecting, recovering, repairing, support maintenance, and quality control of
63 wheeled vehicles with towed loads for a Hawk firing platoon deployed in support of ODS.

	c.  Headquarters, 1st Armored Division, Operations Order 00-159 (Forged Victory), dated 1 November 2000; Headquarters, Task Force 1, 501st Aviation, Task Force Falcon, memorandum, dated 6 May 2001, subject:  Verification of Deployment; NATO Medal Certificate; and Kosovo Forces, Task Force Dragoon I, Certificate of Achievement, that show the commanding officer verified the applicant deployed to Kosovo in support of Operation Joint Guardian (OJG) from 21 January through 10 May 2001 and that the applicant was awarded the Kosovo Campaign Medal and NATO Medal.

5.  Information retrieved from the Gulf War Deployment Roster shows the applicant was deployed to SWA with Battery A, 6th Battalion, 52nd Air Defense Artillery (WGMRC0), from 13 February through 5 May 1991.

6.  During the processing of this case, the General Processing Branch, Defense Finance and Accounting Service (DFAS), Cleveland, OH, was asked to verify information relevant to the applicant's receipt of Hostile Fire Pay/Imminent Danger Pay (HFP/IDP).  DFAS confirmed that the applicant received HFP/IDP from 20 January through 10 May 2001 for service in Macedonia.

7.  Army Regulation 600-8-22 (Military Awards) states the Kosovo Campaign Medal is awarded to members of the Armed Forces of the United States who, after 24 March 1999, participated in or served in direct support of designated operations, including OJG (11 June 1999 through a date to be determined) within the area of eligibility.

	a.  A bronze service star will be worn for participation in each campaign.

	b.  The Kosovo Defense Campaign began on 11 June 1999 to a date to be determined.

8.  Army Regulation 635-5 (Personnel Separations - Separation Documents), in effect at the time, prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, release from active duty service, or control of the Active Army.

	a.  Chapter 2, paragraph 2-4, contains item-by-item instructions for completing the DD Form 214.

	b.  Item 18 states use this block for entries required by Headquarters, Department of the Army, for which a separate block is not available and for completing entries too long for their blocks.

       (1)  For an active duty Soldier deployed with his or her unit during their continuous period of active service, enter the statement, "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)."

       (2)  For a Soldier who served in a HFP/IDP area, "Served in a designated Hostile Fire Pay area" or "Served in a designated Imminent Danger Pay area."

DISCUSSION AND CONCLUSIONS:

1.  The applicant contends that his DD Form 214 should be corrected to show he served in the IDP areas of SWA from 15 December 1990 to 4 May 1991 and Kosovo from 21 January to 10 May 2001.

2.  Item 18 of the applicant's DD Form 214 confirms he served in a designated IDP area.

3.  The evidence of record shows:

	a.  The applicant's commanding officer verified that the applicant served in SWA in support of ODS from 15 December 1990 through 4 May 1991.  The Gulf War Deployment Roster confirms he served from 13 February through 5 May 1991.

	b.  The applicant's commanding officer verified that the applicant served in Kosovo in support of OJG from 21 January through 10 May 1991. DFAS confirmed he served from 20 January through 10 May 1991.

4.  Based on the available records and evidence of record, the Board concludes it would be appropriate to correct the applicant's DD Form 214 to show he served in the IDP areas:

* SWA from 15 December 1990 through 5 May 1991
* Kosovo from 20 January through 10 May 1991

5.  Records show the applicant was awarded the Kosovo Campaign Medal for his service in support of OJG and that he served in Kosovo during the Kosovo Defense Campaign.  Therefore, it would be appropriate to correct his records and add the Kosovo Campaign Medal with 1 bronze service star.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by:

   a.  adding to item 13 of his DD Form 214 the Kosovo Campaign Medal with
1 bronze service star; and

   b.  adding to item 18 of his DD Form 214 the entries:

* "SERVICE IN SOUTHWEST ASIA FROM 19901215-19910505"
* "SERVICE IN KOSOVO FROM 20010120-20010510"
