THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests reconsideration of his previous request for correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the Navy Unit Commendation (NUC).

2.  The applicant states he is presenting new evidence that was not considered by the Board as relates to his eligibility to wear the NUC.  He contends that Headquarters (HQ), III Marine Amphibious Force (III MAF) was awarded the NUC for two different periods and he was assigned to that unit during the second period.

3.  The applicant provides letters from HQ, U.S. Marine Corps and the National Personnel Records Center, Navy Personnel Command Transmittal of and/or Entitlement to Awards, and HQ, III MAF NUC Citations.

CONSIDERATION OF EVIDENCE:

1.  Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20100018288 on 22 March 2011.

2.  The applicant provides HQ, III MAF NUC Citation for the period 1 July 1968 to 14 April 1971 and a letter from HQ, U.S. Marine Corps which were not previously considered by the Board.  These documents are new evidence which warrant consideration by the Board.
3.  The previous Record of Proceedings concluded the applicant was not entitled to correction of his DD Form 214 to add the NUC because he was not assigned or attached to the HQ, III MAF during the period that unit was awarded the NUC (6 May 1965 - 30 June 1968).

4.  HQ, U.S. Army Military Assistance Command Vietnam Special Orders Number 265, dated 21 September 1968, directed his reassignment to HQ, III MAF for duty as an enlisted aide with a reporting date of 23 September 1968.

5.  The applicant's DA Form 20 (Enlisted Qualification Record) shows in item 
31 (Foreign Service) that he served in the Republic of Vietnam from 8 September 1968 to 30 August 1969.

6.  He was released from active duty on 22 January 1970.  His DD Form 214, as amended by a DD Form 215 (Correction to DD Form 214), dated 2 July 2010, shows in item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) the following:

* National Defense Service Medal
* Republic of Vietnam Campaign Medal
* Army Commendation Medal
* two overseas service bars
* Army Good Conduct Medal
* Vietnam Service Medal with four bronze service stars
* Republic of Vietnam Gallantry Cross with Palm Unit Citation
* Expert Marksmanship Qualification Badge with Rifle Bar
* Navy Achievement Medal with Combat "V"

7.  He provided a letter from HQ, U.S. Marine Corps, Quantico, VA, dated 
19 January 2010, and addressed to him, which confirms the HQ, III MAF was awarded the NUC for the periods 6 May 1965 - 30 June 1968 and 1 July 1968 - 14 April 1971.  The NUC Citations were provided to him as enclosures to the letter.

DISCUSSION AND CONCLUSIONS:

1.  The applicant's contention that his DD Form 214 should be corrected to show the NUC has been carefully reviewed.

2.  Orders show he was reassigned to the III MAF with a reporting date of 
23 September 1968.  A letter from the HQ, U.S. Marine Corps confirms the HQ, III MAF was awarded the NUC for the period 1 July 1968 to 14 April 1971.
3.  Therefore, there is sufficient evidence to justify correcting his DD Form 214 by adding the NUC.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant amendment of the ABCMR’s decision in Docket Number AR20100018288, dated 22 March 2011.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending item 24 his DD Form 214 by adding the Navy Unit Commendation.
